Description:
Supply of SUSE or equivalent software to the ordinary courts and the Ministry of Justice and accompanying services - Framework Agreement

1. The subject of the proceedings is the conclusion of a framework agreement for the selection of intermediaries in obtaining and delivering to the Units all types of licenses based on subscriptions to the SUSE Manufacturer's software, indicated each time in the current Manufacturer's Price List or equivalent software, together with technical support, and the provision of expert support services of the Manufacturer and consulting support of the Contractor, in the scope of the manufacturer's software provided.

2. The framework agreement shall specify all the conditions for the performance of supplies or the provision of services and the conditions for the selection of Contractors who will make deliveries or perform services to the Units from among the Contractors who are party to the framework agreement.

3. Procurement will be carried out successively, depending on the needs of the Units, after the Unit has submitted an application for the contract, the Contractor has received a reply to the request for the order and the choice of the Contractor who will perform the order (the implementing procedure).

2.The Framework Agreement shall specify all conditions for the provision of supplies or services and the conditions for the selection of Contractors who will carry out deliveries or perform services for the Units.

3.The purpose of a framework agreement shall be to lay down the terms and conditions governing contracts which may be awarded during the term of the framework agreement indicated in the Ch. IV SWZ.

4. The execution of orders will take place successively, depending on the needs of the Units, after the Entity submits an application for the contract, obtains a response from the Contractor to the request for the contract and selects the Contractor who will perform the given order (executive procedure).

5.Pursuant to Article 134(2)(7) of the PPL Act, the Contracting Authority indicates that it will conclude a framework agreement with a maximum of two Contractors who will obtain the highest number of points as part of the evaluation of tenders on the basis of the criteria set out in this SWZ and whose offer price does not exceed the amount intended to finance the framework agreement, with the proviso that the Ordering Party may increase this amount.

6.The list of products and the expected quantities of products and services specified in Annex 1A to the SWZ – Price Form have been indicated in order to prepare an offer, based on the planned purchases of Units. The Ordering Party indicates that the Units are entitled to apply for an order for each product appearing in the current Manufacturer's Price List. Contractors are not entitled to claim deliveries and services in the indicated quantities. These quantities may change at the stage of order processing by individual Units, provided that the maximum value of the framework agreement is not exceeded.

7.The subject of the implementing agreements is the acquisition and delivery to the Units of all types of licenses based on subscriptions to the SUSE Manufacturer's software indicated in the Manufacturer's Price List or equivalent software, together with technical support and the provision of expert support services of the Manufacturer and consulting support of the Contractor in the scope of the manufacturer's software provided.

8. The Ordering Party requires that the subject of the contract be provided by the Contractor, who has the following rights to sell the offered products on the Polish market:

1) the status of a partner authorized by the SUSE Manufacturer entitling to provide products and services;

2) in the case of offering equivalent software – authorization of the Manufacturer to sell the offered equivalent solution and provide services.

9. A detailed description of the subject of the contract is attached. No. 2 to SWZ.

10.The list of Entities that may award contracts or to which contracts may be awarded is attached. No. 8 to SWZ.
