Supply of electricity for the Marshal's Office of the Malopolska Region, provincial self-government organizational units and provincial legal persons in 2023 and 2024.

1. 1. The subject of the contract is the supply of electricity within the meaning of the Energy Law Act of 10 April 1997 (i.e. Journal of Laws of 2022, item 1385, as amended) for the needs of contracting authorities with a total maximum volume: 30 496 895.00 kWh in the delivery period, i.e. not earlier than from 01.10.2023 to 31.12.2024, with the proviso that deliveries to individual electricity consumption points will start not earlier than after effective termination applicable energy supply agreements and a positive change of supplier procedure.

2. The tender procedure is conducted by the Malopolska Region in the name and on behalf of voivodship self-government organizational units, voivodship legal persons who have concluded an Agreement with the Marshal's Office of the Małopolska Region for this purpose.

3. Energy supply will be carried out on the basis of contracts concluded separately by the respective Contracting Authority.

4. Distribution services will be provided under separate agreements concluded with local Distribution System Operators.

5. The electricity supplied must meet technical standards in accordance with the provisions of the Act of 10 April 1997. Energy Law (i.e. Journal of Laws of 2022, item 1385, as amended) executive acts and Polish Standards.

6. At the same time, the Contracting Authority informs that it currently has contracts for the sale of energy, entered into as comprehensive and only for sale, following the subsequent change of the seller. The information on the contracts is contained in Annex 1D to SWZ.

7. The proposed provisions of the public procurement contract, which contains the conditions for the performance of the contract, are contained in the model contract constituting Annex 1C to the SWZ.
