1. The given quantities of articles are estimates and may change during the term of the contract, provided that the value of the purchased articles will not exceed the value of the contract. The Ordering Party declares that the changes will not result in a reduction in the value of the contract by more than 30% of the amount offered.
2. The subject of the contract must comply with Polish Standards, free from defects and impurities, with a specific color, taste and smell. Articles must be from fresh production dates (shelf life: 3 days). Bread must be produced with the addition of an anti-mold improver. It can not be burned, deformed, of small volume. The Ordering Party considers unacceptable crumb crushing, moist crumb, crumb scallion, gray color or crumb streaks.
3. Packaging must be made of materials intended for contact with food.
4. The Contractor undertakes to present at each delivery a commercial HDI identification document in the form of a bulk label or health certificate in accordance with applicable regulations.
5. Detailed delivery conditions:
1) Deliveries of articles specified in the above table will be carried out to two food warehouses of the Ordering Party, located in the Detention Center in Gdańsk at 12 Kurkowa Street and the External Branch in Gdańsk – Przeróbka at 23 Siennicka Street.
2) The Contractor will supply the articles, specified in the table, by his own transport, at his expense. The means of transport must comply with the applicable sanitary requirements for the carriage of food items.
3) Acceptable bulk packaging: plastic containers (refundable on subsequent delivery) or cardboard non-refundable.
4) Deliveries will take place from Monday to Saturday, except Sundays and holidays, on agreed dates, from 08:00 to 11:00. Orders will be placed by phone or e-mail at least 24 hours in advance of the planned delivery. The Ordering Party reserves the right to make adjustments to the ordered quantities depending on current needs. The contractor is not entitled to claim in this respect.
5) The Contractor shall secure duly the goods for the duration of carriage and shall be fully responsible for the delivery and quality of the goods delivered.
6) The Contractor shall take responsibility for deficiencies and defects arising during the transport of the goods and shall bear all legal consequences thereof.
7) Quantitative and qualitative acceptance of the goods will be carried out in the presence of a representative of the Contractor and the Ordering Party, in the warehouse of the Ordering Party, based on the order placed. Delivered products must be marked in such a way that it can be identified without having to disturb the packaging.
8) The marking must cover all information in the form of inscriptions and other indications, including trademarks, trade names, graphic elements and symbols, concerning the foodstuff, placed on the packaging, label, dust jacket, leaflet, pendant and in documents which are attached to this foodstuff or refer to it. Each unit packaging of the breads shall be provided with information on the shelf life and the other information concerning the marking of the foodstuffs provided may be contained in the accompanying documents.
9) Quality assessment will be carried out through organoleptic evaluation of the supplied assortment, assessment of transport and packaging conditions. The Purchaser has the right not to accept the entire delivery if there is a risk that the disputed delivery parameter may have a negative impact on the safety of all delivered food.
10) If the Contracting entity submits objections to the Contractor regarding the delivered assortment, its quality or quantity, the Contractor shall replace the disputed articles within 6 hours from the moment of their notification.
