1. The subject matter of this order shall be:

1.1. supply of electricity to the facilities listed in Annex 1 to the SWZ – description of the subject of the contract. The demand for electricity in the period from 01.06.2023 to 31.12.2024 is: 4 250 700 kWh (planned order).

1.2. commercial balancing service (hereinafter also referred to as the POB service) for energy consumption points with an installed RES Installation (micro-installations and small installation) in the period from 01.06.2023 to 31.12.2024. Information on RES installations is included in Appendix No. 1 to SWZ description of the subject of the contract. Energy production takes place all year round, 24 hours a day (except for maintenance breaks and breakdowns). The amount of energy produced by the installations and put into the grid is: 20 170 kWh (planned quantity).

Information on the amount of energy generated and delivered to the grid is included in Annex 1 to the SWZ. The energy will be used for the customer's own needs. 2. The Contractor referred to in this proceeding undertakes to purchase electricity generated in the contracting party's installations. The Contractor referred to in this proceeding undertakes to conclude a contract with the contracting authority for the sale by the contracting authority to the contractor of electricity generated in the contracting authority - the Energy Purchase Agreement. The conclusion of the Energy Purchase Agreement must take place before the conclusion of the contract for the sale of electricity on the model proposed by the contractor taking into account the provisions of the contract for the Energy Purchase Agreement, which are Annex 3 to the Designed provisions of the Agreement - Annex No 2 to the SWZ.

3. The detailed scope of the contract is set out in Annex 1 to the SWZ, in accordance with the provisions of the Act of 10 April 1997 Energy Law. The other conditions for the execution of the contract are set out in the proposed provisions of the Electricity Sales Agreement — Annex No 2 to the SWZ.

4. Distribution services will be provided on the basis of a separate agreement concluded by the Ordering Party with the relevant Distribution System Operator (called DSO) – DSO data are included in Appendix No. 1 to SWZ. The reserve seller is: Enea SA., PKP Energetyka SA.

5. Requirements (obligations) to the contractor are described in the proposed provisions of the sales contract, which are Annex 2 to the SWZ. Execution of the actions arising from the power of attorney, which is Annex 2 to the Agreement for the sale of electricity, hereinafter referred to as the Agreement.

6. Existing contracts for the sale of electricity with existing electricity sellers for electricity consumption points included in Annex 1 of the SWZ are concluded for an indefinite period, and the exact description for each of the PPE points can be found in the column called "Duration of the contract / notice period".

7. Annex 1 SWZ informatively indicates the current parameters (tariff group/contractual capacity) which may be subject to change during the duration of the electricity contract.

8. In the course of the performance of the contract, the ordering party reserves the right to reduce or increase the total amount of energy purchased / put into the network in the scope of: increasing to 15%, reducing to 15%, in relation to the consumption / commissioning of electricity indicated in paragraph 4.1. paragraphs 4.1.1 and 4.1.2.SWZ. The occurrence of the circumstances referred to above will result in a reduction or increase in the remuneration due to the contractor for the performance of the contract, respectively. The reduction in the amount of electricity shall not give rise to any claims on the part of the contractor. The scope and principles of making changes are described in point 4.10 of the SWZ
