The subject of the contract is: granting a long-term bank loan in the amount of PLN 8,645,000.00 for repayment of previously incurred liabilities under loans, credits and issued bonds and financing the planned budget deficit of the Commune in 2022., Municipality of Ostrów Wielkopolski, Wielkopolskie Province" in accordance with Resolution No XLVIII/480/2022 of the Ostrów Wielkopolski Commune Council of 11 July 2022.
Loan activation - non-cash; the loan will be activated in two tranches,
I tranche: PLN 6,000,000.00 until 7.10.2022.
II tranche: PLN 2,645,000.00 until 31.10.2022
The subject of the contract is: granting a long-term bank loan in the amount of PLN 8,645,000.00 for repayment of previously incurred liabilities under loans, credits and issued bonds and financing the planned budget deficit of the Commune in 2022., Municipality of Ostrów Wielkopolski, Wielkopolskie Province" in accordance with Resolution No XLVIII/480/2022 of the Ostrów Wielkopolski Commune Council of 11 July 2022 on the following terms:
1) PLN loan,
2) variable interest rate on the loan, calculated for each monthly interest period based on the WIBOR 3 M index (with a base rate of 3 M to be calculated as the arithmetic mean of the last five quotes in the month preceding the month of interest accrual)
3) repayment of the loan - in 35 quarterly installments (the amount of individual installments according to Annex 2 to the SWZ entitled "Repayment schedule of loan installments"), on the last day of the third month of the quarter,
4) interest repayment - on an ongoing basis on the amount of the loan mobilised, in monthly periods, on the last day of each month; the contractor will not charge interest on the amount of unused credit,
5) starting the loan - non-cash; the loan will be activated in two tranches,
I tranche: PLN 6,000,000.00 until 7.10.2022.
II tranche: PLN 2,645,000.00 until 31.10.2022.
The loan will be launched (without any conditions on the part of the lending bank) at the request of the Municipality of Ostrów Wielkopolski. The loan will be activated by transferring funds to the budget account of the Municipality of Ostrów Wielkopolski, established in the bank performing bank budget service,
6) securing the loan - a blank promissory note with a promissory note declaration,
7) does not provide for any fees and commissions,
8) the ordering party reserves the right to use part of the granted credit without incurring additional fees for non-use of the entire granted loan,
9) the contracting authority reserves the right to repay part or all of the loan early without incurring additional fees, with possible repayment taking place after notifying the contractor of the planned early repayment at least 7 days in advance.
10) the margin is fixed during the term of the contract.

1.3 Due to the specificity of the subject of the contract, the contracting authority, acting in accordance with Article 121 of the PPL Act, reserves the obligation for the contractor to perform a key task in person, i.e. to grant a bank loan
1.4.The Ordering Party informs that the opinion of the Regional Chamber of Accounts in Poznań on the possibility of repayment of the loan will be made available to the Contractor before signing the contract.
