Description:
Purchase of diesel fuel

1. The subject of the contract is the successive delivery of diesel oil for the needs of ZGO AQUARIUM Sp. z o.o. in the period from 01.01.2024 to 31.12.2024 in the amount of approximately 160,000 liters, with the right to increase deliveries to 200,000 liters according to the needs of the Ordering Party. The customer specifies the estimated amount of diesel demand that may change during the term of the contract.

2. The fuel will be delivered successively, in accordance with the Ordering Party's own needs, in batches of approx. 5,000.00l – 10,000.00l. Diesel fuel will be collected in three above-ground fuel storage tanks with a capacity of:

- 1 tank - 2.500,00 liters,

- 2 tanks – 5,000.00 liters each.

The expected consumption of diesel fuel per week is 3.5-4 thousand l.

3. A detailed description of the contract is described in the SWZ, chapter IV - Description of the subject of the contract.

The customer specifies the estimated amount of diesel demand that may change during the term of the contract.

2. The fuel will be delivered successively, in accordance with the Ordering Party's own needs, in batches of approx. 5,000.00l – 10,000.00l. Diesel fuel will be collected in three above-ground fuel storage tanks with a capacity of:

3. Deliveries of diesel oil will be ordered by phone or email to the e-mail address indicated by the Contractor.

4. Deliveries of diesel oil shall be carried out by means of transport of the Contractor and at its expense.

5. Diesel fuel shall be delivered by a specialised transport vehicle equipped with a legalised system for measuring pumped fuel. Vehicles transporting diesel fuel, which will be carried out transport fuels, must meet all the requirements set out in the law in the field of international road transport of dangerous goods (ADR).

6. The quality of the fuel offered should meet the requirements contained in the applicable regulations, in particular in the Act of 25 August 2006 on the fuel quality monitoring and control system (i.e. Journal of Laws of 2023, item 846, as amended) in the Regulation of the Minister of Economy of 9 October 2015 on quality requirements for liquid fuels (Journal of Laws of 2015, item 1680, as amended) and the requirements set out in PN-EN 590+A1:2017-06.

7. Each delivery should be confirmed by a delivery note or a GIN document of the Contractor, containing the date of delivery and the quantity of diesel fuel delivered at a reference temperature of 15oC. The Contractor shall provide the Contracting Authority with a printout from the tank truck containing information about:

- the quantity of fuel discharged into the storage tank at a reference temperature of 15 °C,

- the quantity of litres of fuel at the actual temperature of the fuel discharged.

In addition, the Contractor must provide a valid fuel quality certificate, certified by the manufacturer or an accredited laboratory certificate, in Polish at each fuel delivery. The certificate shall be linked to the Contractor's delivery note or delivery note by including the number and date of delivery.

8. The Contractor shall include in its offer the cost of fuel delivery to the ZGO Plant with its registered office in Pukinin No. 140, Rawa Mazowiecka commune.

9. The Ordering Party reserves the right to carry out random checks of the delivered diesel fuel in terms of quality and compliance with the delivered quality certificate, by taking samples and performing tests. In the event of a dispute arising between the parties over the quality of the supplied diesel oil, in the presence of a representative of the Contractor and the Contracting Authority, three samples will be taken and sealed, which will be sent to an accredited laboratory. If the laboratory confirms the non-compliance of the supplied diesel oil with the PN-EN 590 + A1: 2017-06 standard, all costs related to conducting tests and repair costs resulting from poor quality diesel oil shall be borne by the Contractor. Otherwise, these costs shall be borne by the Ordering Party.

10. The Contractor shall be obliged to hold, throughout the term of the contract, civil liability insurance in the scope of its business activity in accordance with the subject of the contract. If it is necessary to continue the insurance, he is obliged to submit to the Ordering Party without a separate request a document confirming the continuation of insurance.
