The subject of the contract is a service for the collection and management of biodegradable waste with the code 20 02 01, in a way that ensures the transfer of responsibility for waste management to the next waste holder.

2. Biodegradable waste (20 02 01) – municipal waste collected in accordance with
with the guidelines of the Ministry of Climate and Environment, i.e. m.in the so-called green and food residues from households and housing estates collected by residents or security services in bulk or in bags – in accordance with local regulations for maintaining cleanliness and order in the Company's home municipalities.
3. Biodegradable waste may contain about 10% of the biodegradable fraction of municipal kitchen waste.
4. The amount of waste with the code 20 02 01 intended for reception and management under the basic order is 600 Mg, including: in the bag system – up to 300 Mg
and in a bagless system – up to 300 Mg.
5. The Ordering Party has no influence on the size of the waste stream received, due to the high variability of this stream. Therefore, the Contracting Authority, as part of this contract, allows the exercise of the option right referred to in Article 441(1) of the Public Procurement Law. The contracting authority may exercise the right of option in whole or in part, once or in several parts. An option is envisaged to increase the amount of waste intended for reception and management with the code 20 02 01 additionally to 800 Mg, including: in the bag system – up to 400 Mg, in the bagless system – up to 400 Mg.
6. Due to the inability of the Ordering Party to estimate the amount of waste in and without bags – the estimated total weight of waste to be managed (i.e. in a bag and without a bag) is about 650 Mg within 12 months. The options will be triggered depending on how the residents collect biowaste.
7. The Ordering Party shall exercise the right of option if there is a need for further provision of the above-mentioned services.
8. The maximum possible scope of the order if the Ordering Party exercises the option is up to 1 400 Mg, including: 600 Mg as part of the basic order and up to 800 Mg
as part of the option.
9. Waste with the code 20 02 01 is collected at the Reloading Station in Polska Wieś in boxes.
10. The Contractor shall collect the above-mentioned waste from the Contracting Authority from the Reloading Station in Polska Wieś 24a, Mrągowo municipality within 48 hours from the date of notification of the demand for collection by the Contracting Entity. Loading on the side of the Ordering Party.
11. Waste received from the Contracting Authority will be transferred to the entity holding the decision referred to in Article 27 (2) (1) or (2) of the Act of 14 December 2012 on waste indicated by the Contractor prior to the signing of the contract.
12. Bio-waste will undergo aerobic or anaerobic treatment to produce compost, digestate or other non-waste material or substance.
13. The obtained compost, digestate or other material will be used as a product, material or substance and placed on the market as a fertilizer or soil improver on the basis of a permit from the minister competent for agriculture (certificate).
14. Due to the subject matter, the contract must be performed, in particular in accordance with the nw. Provisions:
1) the Waste Act of 14 December 2012;
2) the Act of 27 April 2001 Environmental Protection Law;
3) the Act of 13 September 1996 on maintaining cleanliness and order in municipalities,
and other laws and regulations applicable to the subject of the contract.
15. Due to the fact that the Ordering Party has no influence and is not responsible for the quantities of waste sent to its installations and their quality, they are not guaranteed by the Ordering Party.
16. For settlements between the Parties, the amount of waste collected shall be determined by measurement on the electronic truck scale of the Ordering Party.
