1. The subject of this contract is the supply of electricity to the facilities listed in Annex 1 to swz. The electricity demand in the period from 01.01.2023 to 30.06.2024 is: 1 970 045 kWh (planned order).
2. Municipality of Rokietnica – the Contracting Authority acts on its own behalf (Commune Office in Rokietnica) and on behalf of the following entities;
a) Jan Brzechwa Primary School in Rokietnica.
b) Kindergarten "Bajeczka" in Rokietnica,
c) School and Preschool Complex in Napachań,
d) School and Preschool Complex in Cerekwica.
The subject of the contract is the supply of electricity with established quality standards. The price does not affect the quality of the service provided, i.e. the supply of electricity. Electricity cannot be adapted to the specific requirements of the Ordering Party – it is standardized and offered in generally accepted standards.

The rules for the functioning of the power system are set out in the Regulation of the Minister of Economy of 4 May 2007, while the rules for shaping and calculating tariffs and settlements in electricity trading are set out in the Regulation of the Minister of Energy of 6 March 2019 on detailed rules for shaping and calculating tariffs and settlements in electricity trading. This means that the supply of electricity is a supply of the same kind. Electricity purchased by the Ordering Party has the same purpose regardless of whether it is supplied to the Commune Office, educational facilities or others. In addition, the entire delivery may be provided by one Contractor at one time. Any attempt to divide the contract into parts, e.g. according to meters, tariff groups, will result in the partial performance of the contract not being profitable for any of the Contractors, due to the small volume of electricity in part of the contract.
4.3. The detailed scope of the contract is specified in Annex 1 to the SWZ, in accordance with the provisions of the Energy Law Act of 10 April 1997. Other conditions regarding the execution of the contract are specified in the draft provisions of the electricity sales contract – Appendix No. 2 to the SWZ.
4.4. The supply of electricity will be carried out under the conditions laid down by the provisions of the Act of 10 April 1997 — Energy Law and in accordance with the implementing provisions issued thereto, in particular with the quality standards of customer service set out in the Regulation of the Minister Energy of 6 March 2019 on detailed rules for the formation and calculation of tariffs and clearing in electricity trading. The quality parameters of electricity in the distribution part are governed by the Regulation of the Minister of Economy of 4 May 2007 on the detailed conditions for the operation of the electricity system.
4.5. Distribution agreements are provided on the basis of separate agreements concluded between the Ordering Party and the Distribution System Operator.

4.6. The seller of electricity is Enea S.A. Pastelowa 8, 60-198 Poznań.
