Provision of an automated solution including the distribution of folded professional clothing and the collection of dirty clothing (hereinafter referred to as DAV), installation, training, technical start-up assistance, technical maintenance and maintenance of the computerized system of automatic clothing distribution (hereinafter referred to as DAV) at the Rennes University Hospital. The public market includes:
- a share of foreseeable services concluded at global and fixed price;
- a share of non-programmable services concluded at unit prices. The proportion of foreseeable services corresponds to the complete DAV equipment (DAV solution and computerized system), to the complementary technical services (delivery, installation, commissioning, training), to the guarantee and to the maintenance. The share of non-programmable services corresponds to licenses and additional training.
This public market was already the subject of a first consultation launched on 8.10.2019 (JOUE 2019 notice / S 197-477861, BOAMP notice 19-152340). This procedure was declared without result. Indeed, the recipient of the public contract was placed in compulsory liquidation on 9.1.2020 by the Commercial Court of Versailles. Article L. 2141-3 of the public procurement code provides: "The following are excluded from the procurement procedure: 1) subject to the judicial liquidation procedure provided for in article L. 640-1 of the code trade or subject to an equivalent procedure governed by foreign law; [...] ". Thus, the present consultation is relaunched in a call for tenders opened in application of articles L. 2124-2, R. 2124-2, 1º and R. 2161-2 to R. 2161-5 of the public procurement code. The public market is a framework agreement which fixes all the contractual stipulations. It is executed as and when order forms are issued under the conditions set out in articles R. 2162-13 and R. 2162-14 of the public procurement code. The framework agreement is concluded without minimum and without maximum for its entire period of validity within the meaning of article R. 2162-4, 3º of the public procurement code.
