1. The subject of the contract is the provision of specialist care services for adults with mental disorders from the area of Gdynia, hereinafter referred to as "Services", specified in the Act of 12 March 2004 on social assistance and the Regulation of the Minister of Social Policy of 22 September 2005 on specialist care services, in the following areas of activity:

(a) DOPS district no. 1 — Districts: Redłowo, Orłowo, Karvinas, Dąbrowa, Mały Kack, Wielki Kack, part of St. Maximilian Hill, part of Wiczlin.

(b) DOPS District No 2 — Districts: Oksywie, Obland, Foothills;

(c) DOPS district no. 3 — Districts: Grabówek, Leszczynki, Chylonia, Pustki Cisowskie, Demptowo, Cisowa;

d) DOPS District No. 4 — Districts: Downtown, Kamienna Góra, part of St. Maximilian Hill, Forest Plots, Witomino, Chwarzno — Wiczlino.

A detailed description of the subject of the contract is indicated in the SWZ

1) Services will be provided in the dimension of poppies. 99 600 hours during the term of the contract, for the benefit of approximately 125 persons per month, indicated by the Ordering Party, 7 days a week from 7:00 to 21:00. This is estimated to have 58,100 hours in 2023 and 41,500 hours in 2024. This number of hours is used for the purpose of calculating the offer price.

2) The Contracting Authority reserves the right to reduce the expected maximum number of hours of the Services provided, in particular depending on the number of persons applying for the indicated form of assistance or incomplete securing of funds for the provision of Services by the Pomeranian Voivode. The above number of hours of Services is the maximum, while the minimum number of hours of Services provided during the period of completion of the subject of the contract is 63,000 hours. The Contractor is not entitled to a maximum order of hours. In the case of ordering an incomplete number of hours, the Contractor will only be entitled to remuneration resulting from the Services provided and he will not make claims for the performance of the remaining part.

3) Detailed information on the subject of the contract and the manner of its implementation is specified in Annex 1 to SWZ - Gdynia standard of specialist care services provided at the place of residence

4) The individualized scope of Services for each person covered by them shall be determined by the Contracting Authority in administrative proceedings and provided in writing as part of the contract concluded with the selected Contractor.

5) The Contractor will be obliged to provide high-quality care services in accordance with the law.

6) The Contractor will be obliged to dispose of the premises in Gdynia for the purposes of coordination, settlement and contact in matters of services provided. The premises should have a direct telephone number, access to e-mail and be available to visitors at least between 8:00 and 16:00 on working days.

7) The Contractor shall be obliged to cooperate with the Contracting Authority in the implementation of Telecare for persons covered by specialist services at the place of residence,

8) The Ordering Party reserves the right to supervise and control the implementation of the Services and other obligations arising from the contract. The Contractor with whom the Contracting entity concludes a contract shall be obliged to keep relevant documentation specified in the contract, as well as to make available to the Contracting entity or persons authorized by the Contracting entity all documentation allowing to confirm the correctness of the contract performance

2. The description of the subject of the contract is set out in the SWZ in this draft contract, which constitutes Annex 2 to the SWZ. 3.The Contracting Authority does not provide for the obligation of the Contractor to carry out a site inspection and check by the Contractor the documents necessary for the performance of the contract available on site at the Contracting Entity. 19. The Ordering Party does not allow partial bids (the contract has not been divided into lots). The contract in question constitutes an inseparable whole for organisational and economic reasons. The contracting authority executes orders for various care services, dividing them in terms of their specialist character and taking into account the welfare of the charges. The Contracting Authority does not provide for granting advances for the performance of the contract.TOTAL GROSS OFFER PRICE PLN The Contractor calculates as follows: Estimated Number of hours in 2023, i.e. 58100 hours times offered unit price for 1 hour in 2023 plus Estimated Number of hours in 2024, i.e. 41500 hours times the offered unit price for 1 hour in 2024. In the criterion for the evaluation of tenders Staff Replacement, the Contracting Authority shall award additional points to those bids in which the Contractor provides for the performance of the contract a greater than required as a minimum number of persons meeting the requirements set out in Chapter VIII, paragraph 2, point 2.1.
