The Ordering Party requires that the transport be carried out "exclusively", i.e. the Ordering Party does not allow other persons to be in the vehicle during the execution of the contract other than those authorized by the Ordering Party.7. The Contractor is obliged to take into account the following assumptions:1) the child should be transported to school (kindergarten) in such a time that he or she can start classes as planned, the waiting time for classes may not be longer than 30 minutes.2) timetables must be obtained from each school before the implementation of the task and each year on the day of the beginning of the school year. 3) The Contractor is obliged to determine, in consultation with the Contracting Authority, detailed hours of courses with a person designated by the school and kindergarten head and parents - guardians of pupils (based on the pupils' weekly timetable). The contractor will provide each child, on a given route, with transport to school (kindergarten) on time, as well as return home. The child should stay on the journey as short as possible, but not longer than 1 hour 45 minutes in total. daily.4) the timetable should include the carriage of more children at one time. Courses providing for the transport of only one - two children are allowed only in cases of ordering delivery by the Ordering Party. In this case, the Ordering Party shall separately determine the schedule, transport route and number of children. At the beginning of each school year and semester, as well as after each change in the schedule of classes in schools resulting in a change in the organization of transport, the Contractor will be obliged to submit a transport schedule to the Contracting Entity. The Ordering Party has the right to make corrections and additions to the submitted transport schedule. 5) The Ordering Party absolutely requires that during each course there is a guardian in the vehicle who will watch over the safety of children during transport. 6) the guardian of the transported children must be an adult, prepared to perform basic nursing and care activities, having training or a course in first aid, documented by a certificate, certificate or other document confirming the completion of training, form of improvement or obtaining a qualification. 7) the term care shall be understood as ensuring safety and hygiene conditions during boarding, disembarking and passing of students, which is necessary for this type of transport. The obligation to take care of children takes place when the child enters the vehicle (picking up the child from the parents at the place of boarding and handing over to the school/institution employee (similarly on the way back). 8) Pick-ups may only be carried out by vehicles providing seating for all transported pupils. Vehicles must meet the safety requirements and technical conditions set out in separate regulations. (...) The Contractor is obliged, at the request of the Contracting Entity, to make the vehicles available for inspection in front of the Ordering Party's headquarters. 8. Pursuant to Article 95(1) of the PPL, the contracting authority requires the contractor or subcontractor, on the basis of an employment relationship, to employ persons performing activities in the field of contract performance, the performance of which consists in performing work in the manner specified in Article 22 § 1 of the Act of 26 June 1974 – Labour Code (Journal of Laws of 2022, item 1710, as amended).
