Convert Oracle Database Standard Edition Software License to Oracle Database Enterprise Edition

Convert Oracle Database Standard Edition software licenses to Oracle Database Enterprise Edition.

A detailed description of the subject of the contract, shall include a model contract, as set out in Annex 7 to the SWZ.

1.The object of the order is to convert the Oracle Database Standard Edition software license to

Oracle Database Enterprise Edition - repeat.

2. Licenses must come from the manufacturer's authorized sales channel. Detailed description of the item

the contract contains a model contract, as set out in Annex 7 to the SWZ.

3. The Contracting Authority shall not allow the submission of partial tenders in this proceeding. For it is

a further proceeding under the year-long plan of procurement procedures for

similar deliveries, i.e. procurement of Oracle licenses. No additional breakdown of this order into parts

does not violate the principles of fair competition and equal treatment of the Contractors. It also remains irrelewant

for the possibility of obtaining this order by the SME sector. Authorized entities for sale

the manufacturer's license under the specified channel are entities registered as partners of the manufacturer. None

further division of the order into parts is an objective circumstance arising from the nature of the contract.

4. The Contracting Authority does not require the execution of the contract by protected work establishments, social cooperatives, or

other contractors subject to the provision of Article 94 (1) of the Law of Public Procurement, hereinafter

called the “Act”.

5.The Contracting Authority does not require employment of persons on the basis of employment.

6. The Contracting Authority does not provide for the possibility of awarding contracts referred to in point 8 of Article 214 (1) of the Act.

7. The Contracting Authority shall not permit the submission of variant tenders.

8. The Awarding Entity does not envisage conducting an electronic auction.

9. The Contracting Authority did not conduct preliminary market consultations prior to the initiation of the procedure.

10. The Contracting Authority in this proceeding does not require Contractors to submit the subject

means of evidence.

11. The Contracting Authority, within the limits laid down by Articles 462 and the following Act, allows the possibility of implementation of

the object of the contract by the Contractor using subcontractors. Contractor who intends

entrust the execution of part of the contract to subcontractors, indicate in the offer the parts of the contract whose execution it intends to entrust to the subcontractors, and specify the names of possible subcontractors if

already known.

12. Qualitative requirements referred to in Article 246 (2) of the Act, the Contracting Authority described in detail in § 1

the model contract, as set out in Annex 7 to the SWZ.

13. The Contractor shall, before the expiry of the deadline for submission of tenders, provide a defect of: 30

PLN 000,00 and keep them uninterrupted until the date of the deadline for binding the offer, except in cases,

referred to in points 2 and (3) of Article 98 (1) and (2) of the Act. Details of bringing the vadium have been

described in paragraph 13 of SWZ.
