1. The subject of the order is the delivery of a data storage platform as part of the project entitled: "Acquisition of information from electronic media using artificial intelligence and machine learning methods."
2. Detailed requirements for the subject of the order are an integral part of the description of the subject of the order and are included in Part IV of the SWZ, where in accordance with the provisions of Article 99, paragraph 6 of the Pzp Act, the contracting authority has also indicated the criteria used to assess equivalence.
3. The contractor is obliged to provide the contracting authority with a quality guarantee and is obliged to fulfill the obligations arising from it. The requirements regarding the guarantee are specified in Part III of the SWZ.
4. The delivered subject of the order must be brand new, not displayed in exhibitions, complete, and technically functional. The term "brand new" means the subject of the order originally packaged, unused before the delivery date, excluding the use necessary for testing its proper operation after production.
5. The subject of the order must be free from any physical and legal defects and third-party claims.
6. The delivered subject of the order must come from a manufacturer's distribution channel that does not exclude distribution to the Polish market and ensures the fulfillment of warranty rights.
7. The subject of the order must be delivered to the contracting authority, and all other activities described in the SWZ must be performed.
8. The subject of the order must be delivered to the contracting authority along with operating instructions, drivers, and any accompanying software necessary for proper use of the subject of the order (to achieve full functionality as indicated in Part IV of the SWZ). The contracting authority will not be obliged to make any additional payments, in particular, license fees, while any licenses will be granted as part of the contractor's remuneration. If licenses, codes, or other entitlements are needed to activate and use this software, they must be provided at no additional cost. Codes, licenses, and other entitlements must also be provided if they are necessary to operate or configure hardware components.
9. The delivered subject of the order intended for powering from the electrical network must be equipped with an appropriate number of power cords allowing it to be connected to standard power sockets, unless otherwise indicated in Part IV of the SWZ.
10. The offered subject of the order on the day the offer is submitted cannot be intended by the manufacturer for discontinuation of production or sale.
11. The contracting authority reserves that in case of hard drive failure, the damaged disk remains with the contracting authority.
