1. The subject of the order is the delivery of a data storage platform as part of the project entitled: 'Acquisition of information from electronic media using artificial intelligence and machine learning methods.'
2. Detailed requirements for the subject of the order are an integral part of the description of the subject of the order and are included in Part IV of the SWZ, where in accordance with the provisions of Article 99(6) of the Pzp Act, the contracting authority also indicated the criteria used for assessing equivalence.
3. The contractor is obliged to provide the contracting authority with a quality guarantee and is required to perform the services resulting from it. Requirements regarding the guarantee are specified in Part III of the SWZ.
4. The delivered subject of the order must be brand new, not exposed in showrooms, complete, and technically efficient. The term 'brand new' is to be understood as the subject of the order originally packaged, unused before the delivery date, excluding use necessary for conducting tests of its correct operation after production.
5. The subject of the order must be free from any physical and legal defects and claims from third parties.
6. The delivered subject of the order must come from the manufacturer's distribution channel not excluding distribution to the Polish market and ensuring the realization of warranty rights.
7. The subject of the order must be delivered to the contracting authority and all other actions described in the SWZ must be performed.
8. The subject of the order must be delivered to the contracting authority along with operating instructions, drivers, and any accompanying software necessary for the proper use of the subject of the order (to achieve full functionality indicated in Part IV of the SWZ). The contracting authority will not be obliged to pay any additional fees, especially licensing fees, while any licenses will be granted as part of the contractor's remuneration. If licenses, codes, or other permissions are needed to activate and use this software, they must be delivered without additional charges. Codes, licenses, and other permissions must also be delivered when necessary to activate or configure hardware components.
9. The delivered subject of the order intended for power supply from the electrical network must be equipped with an adequate number of power cables allowing it to be connected to standard power sockets, unless otherwise indicated in Part IV of the SWZ.
10. The offered subject of the order on the date of submission of the offer must not be intended by the manufacturer for withdrawal from production or sales.
11. The contracting authority reserves that in the event of hard disk failures, the damaged disk remains with the contracting authority.
