The subject of the contract is the expansion of the IMID system and development of electronic medical documentation by creating a data analysis module with an AI assistant for summarizing treatment history and providing the module for patients under the National Recovery and Resilience Plan. The contracting authority does not allow for the submission of partial offers. The operation of the patient data and information module requires feeding and close integration and reflection in terms of data, functionality, and processes with the analytical module for proper functioning. Therefore, from the point of view of the contracting authority's interests, including reducing the amount of risks, increasing the effectiveness of control and management over the implementation process within the deadline resulting from the recruitment rules, the contract must be carried out under one agreement with one contractor. The contracting authority does not anticipate awarding contracts mentioned in Article 214, paragraph 1, point 7 of the Public Procurement Law. A detailed description and implementation method of the order are provided in the price table attached as Appendix No. 2 to the Terms of Reference, and the description of the subject of the order ("OPZ") in Appendix No. 3 to the Terms of Reference, as well as the contract template in Appendix No. 5 to the Terms of Reference. In accordance with Article 13, paragraphs 1 and 2, and Article 14, paragraphs 1 and 2 of the Regulation of the European Parliament and of the Council (EU) 2016/679 of April 27, 2016, on the protection of natural persons in relation to the processing of personal data and the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) (EU Official Journal L. 2016 No. 119, p. 1) ("GDPR"), we would like to inform you about the rules for processing personal data in cases where the contracting authority processes your personal data in relation to conducting public procurement proceedings. 2. The administrator of your personal data is the contracting authority. 3. You can contact the contracting authority regarding matters related to personal data protection: 1) by sending a letter to its registered office or electronically via email at: dyr@imid.med.pl or 2) through the ePUAP platform at: /IMiDWarszawa/SkrytkaESP. 4. The contracting authority has appointed a Data Protection Officer ("DPO"), with whom you can contact regarding the processing of your personal data. The contracting authority processes your personal data for the following purposes: 1) conducting public procurement proceedings – based on Article 6, paragraph 1, letter c of the GDPR in conjunction with Article 9, paragraph 2, letter g of the GDPR in conjunction with the provisions of the Public Procurement Law; 2) verifying information about non-conviction within the framework of subjective evidence – based on Article 6, paragraph 1, letter c in conjunction with Article 10 of the GDPR in conjunction with the provisions of the Public Procurement Law; 3) archiving personal data – based on Article 6, paragraph 1, letter c of the GDPR in conjunction with Article 9, paragraph 2, letter j of the GDPR in conjunction with the National Archival Resource and Archival Law; 4) establishing, pursuing, or defending claims related to conducted activities – based on Article 6, paragraph 1, letter e of the GDPR or Article 9, paragraph 2, letter f of the GDPR, i.e., processing is necessary for the performance of tasks carried out in the public interest – proper management of the contracting authority's property, i.e., conducting an important public procurement process, ensuring the proper expenditure of public funds.
