1. The subject of the order is: the supply of a computing cluster for training and using LLM models in a private cloud environment composed of components described in Chapter II of the SWZ, a software package for managing the computing cluster (the package is described in Chapter II of the SWZ), implementation at the Ordering Party's Location, provision of warranty service for the Devices, and provision of technical support for the Software. The subject of the order under the option is the provision of services within Expert Hours (up to a maximum of 600 Working Hours) for the Ordering Party, in accordance with the description included in point VII of Chapter II of the SWZ. 2. The subject of the order has been detailed in Chapter II of the SWZ - Description of the subject of the order. 3. According to Article 139 of the Public Procurement Law, the Ordering Party foresees an inverted order of evaluation of offers, i.e. it will first conduct the examination and evaluation of offers, and then qualify the entity whose offer was evaluated the highest, in terms of the absence of grounds for exclusion and meeting the conditions for participation in the proceedings. 4. The Ordering Party is the administrator of personal data in accordance with the Regulation of the European Parliament and Council (EU) 2016/679 of April 27, 2016 regarding the protection of individuals in relation to the processing of personal data and regarding the free movement of such data and repealing Directive 95/46/EC, hereinafter referred to as “GDPR”. 5. The Contractor submits the offer via the eZamówienia Platform of the Public Procurement Office - https://ezamowienia.gov.pl/pl/. 6. The Ordering Party reserves that, in accordance with Article 257 of the Public Procurement Law, it may invalidate the procurement procedure if the public funds that the Ordering Party intended to allocate for the financing of the order are not granted to it. 7. The offer must be submitted electronically, under penalty of nullity, according to the requirements strictly specified in the SWZ. 8. The Ordering Party will not award the contract if circumstances exist, as specified in Article 5k of Council Regulation (EU) No. 833/2014 of July 31, 2014 concerning organizational measures in connection with actions by Russia destabilizing the situation in Ukraine (OJ EU No. L 229/1 of July 31, 2014), and will exclude the Contractor in the event of at least one of the grounds for exclusion specified in Article 7(1) of the Act of April 13, 2022 on special solutions for countering support for aggression against Ukraine and serving national security protection (i.e. Journal of Laws of 2025, item 514) - to confirm the absence of exclusion grounds, a declaration constituting Annex No. 5 to the Offer Form must be submitted with the offer. 9. The Contractor undertakes to perform the subject of the Agreement within the following deadlines: 1) The Contractor shall deliver servers – 3 units to the indicated Location, within 45 Working Days from the date of contract conclusion. 2) The Contractor shall deliver a switch – 1 unit to the indicated Location, within 45 Working Days from the date of contract conclusion. 3) The Contractor shall perform the Implementation, within 14 Working Days from the date of the delivery of the Devices and signing the quantity protocol. 4) The Contractor shall deliver Software, within 5 Working Days from the date of the delivery of the Devices. 5) Provision of warranty service for the Devices for a period of 60 months from the date of signing the Quality Acceptance Protocol. 6) Provision of technical support for a period of 60 months from the date of signing the Quality Acceptance Protocol. 7) Implementation of Expert Hours under the option from the date of signing the Quality Acceptance Protocol until May 29, 2026. Detailed deadlines for the execution of the order are described in Chapter II of SWZ - OPZ and in Chapter III of SWZ - Draft Provisions of the Agreement. 10. The Ordering Party requires the submission with the offer of the relevant evidence to confirm the compliance of the offered deliveries with the requirements specified in Chapter II of the SWZ - Description of the subject of the order (according to point 6 of Chapter I of the SWZ - Instructions for Contractors). 11. The order is financed from the resources of the European Recovery Fund (Next Generation EU) under Investment C2.1.1: “E-public services, IT solutions improving the functioning of administration and economic sectors” of the Recovery and Development Instrument, National Recovery and Resilience Plan (KPO), in accordance with Agreement No. KPOD.05.06-IW.06-0003/25-00 concluded between the Ministry of Digitization and the State Treasury, on behalf of which operates the Center for Polish Digital Projects (hereinafter: “CPPC”), to support the Project called “Support for the widespread use of electronic document management through the development and provision of a free class EZD system, providing the SaaS2 EZD RP cloud and the implementation of the EZD system in the public administration of Poland” (hereinafter: “Agreement”). All information, promotional, and communication activities related to the execution of the agreement must adhere to the guidelines contained in the Agreement, thus the Contractor is obliged to comply with the recommendations and guidelines of the Ordering Party in this area. The Contractor agrees to familiarize themselves with and appropriately implement the Beneficiary's Guide titled “Compliance of projects financed from the funds of the European Union, including those implemented under the National Recovery and Resilience Plan, with the principle of 'do no significant harm' - 'DNSH principle', as well as the “Promotion and Information Strategy of the National Recovery and Resilience Plan” and the “Visual Identity Book” of the KPO. Furthermore, the Contractor agrees to undergo controls and audits carried out by CPPC and other authorized entities regarding the proper execution of the contract, including the obligation to promptly provide the Ordering Party and the controlling entity with all necessary information and documents in this regard.
