1. The subject of the contract is the construction of a new bus depot in Stalowa Wola.
2. As part of this investment, the following are to be designed and constructed:
- a station service building (i.e. a repair hall with a wash and technical equipment) for buses along with social facilities for technical staff,
- an administrative building,
- a hardened maneuvering area,
- 2 bus shelters - a total of 46 spaces (including 2 with chargers of 2x80 kW each for electric buses) with the possibility of expanding to 40 fast charging stations in the near future – provision of power supply for the installation of remaining prospective chargers along with securing sufficient power connection capacity from the main supply),
- a shelter for hazardous and technological waste,
- a boiler house building for heating oil,
- an underground tank for heating oil with a capacity of at least 20m3,
- 2 underground tanks for rainwater with a capacity of up to 10m3 (for economic purposes - watering plants),
- fencing of the depot area with automatic gates and barriers at the main entrance to the base and at the exit,
- a parking lot (for 60 spaces) for personal cars of base employees and places for bicycles,
- arranged greenery,
- internal installations – electrical energy (including low-current: telecommunications, monitoring, alarm, internal fire alarm system), water and sewage, heating, ventilation, PV 150kW (the location of panels, i.e. installation, direction, and tilt angle, should be done in a way that allows for optimal use of the generated energy for the needs of the designed buildings), technological (compressed air installation in the vehicle maintenance station building, technological installation of the wash, emergency ventilation systems, exhaust systems, and any necessary resulting from the designed function of the premises).
3. In addition, the contractor's tasks as part of the contract will include:
- preparing project documentation in accordance with the attached PFU and applicable laws,
- obtaining all necessary agreements, decisions, and opinions as well as acquiring the decision allowing for the execution of works,
- preparing and approving the project for permanent traffic organization,
- constructing the facility in accordance with the assumptions, functional and utility program, developed project and the decision allowing for the execution of works,
- obtaining all permits, decisions, and documents necessary for the Ordering Party to submit an application for occupancy permit for the completed facilities,
- carrying out the task in accordance with the DNSH principle in the understanding of Article 17 of Regulation (EU) No 2020/852.
4. The Ordering Party reserves that the value of the design works cannot exceed 10% of the contract value.
5. Additionally, the Ordering Party informs that the provision of moving equipment is not included in this order, which will be covered by a separate order at a later date (the supplies of moving equipment excluded from this order are indicated in the attachment - Excluded Supplies of Moving Parts).
6. The detailed scope of the order is specified in the Functional and Utility Program (PFU) and attachments to the PFU, which constitute attachments to the SWZ.
7. The Ordering Party does not require the Contractor to conduct a site inspection or check the documents necessary for the execution of the order on-site at the Ordering Party's location.
8. The Contractor may limit itself to completing section α in part IV of the European Single Procurement Document (JEDZ) and does not need to fill in any of the other sections in part IV of the JEDZ.
9. The order is co-financed by the Polish Agency for Enterprise Development under the European Funds for Eastern Poland 2021 – 2027 Program, Priority FEPW.03 Sustainable Urban Mobility, Action FEPW.03.01 Sustainable Urban Mobility Project Name: “Development of the Mobile Urban Functional Area of Stalowa Wola – Stage I”.
10. The contractor shall be obliged pursuant to Article 95 (1) of the Public Procurement Law to:
1) Employ persons performing tasks in the execution of the contract through an employment contract, whose performance consists in working as specified in Article 22 of the Act of June 26, 1974 - Labor Code (uniform text Journal of Laws of 2022, item 1510, 1700, 2140, of 2023, item 240), performing the following activities:
- works related to the performance of the open raw state; The Ordering Party requires that the persons performing the activities referred to above in the employment relationship with the employer perform work personally, at the place and time indicated by the employer, under his guidance with subordination, for remuneration, with the right to leave.
2) Provide the Ordering Party with a list of persons who will perform the activities referred to in point 1) at the start of the execution of the contract. This list must be updated immediately upon any change of person/people performing the activities referred to in point 1).
3) In the event that the contractor assigns part of the order involving the performance of activities referred to in point 1) to a subcontractor, the obligation to employ persons performing these activities on an employment contract will also apply to the subcontractor.
4) During the execution of the order, the contractor (subcontractor) shall, at the request of the Ordering Party, present evidence confirming the employment of persons referred to in point 10 points 1-3 on an employment contract.
5) In the event of failure by the contractor (subcontractor) to fulfill the obligations referred to in point 10 points 1-3, the Ordering Party anticipates sanctions in accordance with the model contract attached to the SWZ.
6) The above requirement does not apply to the construction manager/works because, according to Article 12 of the Construction Law, the activity of directing construction or other construction works may be performed by a person holding a sole technical function in construction.
