2. The subject of the order is the service of organizing, equipping, and administering the Paid Parking Zone (SPP) in Tuchola for the period: from January 1, 2026, to December 31, 2029. The rules for the operation of the Paid Parking Zone are specified in the resolutions:
- No. XIX/138/20 of the City Council of Tuchola dated February 28, 2020, regarding the establishment of the paid parking zone and the fee rates for parking vehicles and the method of collecting these fees (Official Journal of the Kuyavian-Pomeranian Voivodeship, item 1313 dated March 6, 2020);
- No. XXI/160/20 of the City Council of Tuchola dated May 29, 2020, amending the resolution regarding the establishment of the paid parking zone and the fee rates for parking vehicles and the method of collecting these fees (Official Journal of the Kuyavian-Pomeranian Voivodeship, item 2932 dated June 5, 2020);
- No. XXX/212/21 of the City Council of Tuchola dated January 29, 2021, amending the resolution regarding the establishment of the paid parking zone and the fee rates for parking vehicles and the method of collecting these fees (Official Journal of the Kuyavian-Pomeranian Voivodeship, item 633 dated February 4, 2021);
- No. XXXII/228/21 of the City Council of Tuchola dated April 23, 2021, amending the resolution regarding the establishment of the paid parking zone and the fee rates for parking vehicles and the method of collecting these fees (Official Journal of the Kuyavian-Pomeranian Voivodeship, item 2216 dated April 30, 2021);
- No. XIII/100/25 of the City Council of Tuchola dated March 31, 2025, amending the resolution regarding the establishment of the paid parking zone and the fee rates for parking vehicles and the method of collecting these fees (Official Journal of the Kuyavian-Pomeranian Voivodeship, item 1911 dated April 7, 2025); which constitute attachment No. 1a to this document.
3. The area of the Unmonitored Paid Parking Zone covers approximately 610 parking spaces located in the city of Tuchola.
4. Fees are collected Monday through Friday from 9:00 AM to 5:00 PM, excluding public holidays.
5. Payment for parking in the SPP can be made:
1) by purchasing a parking ticket at the parking meter,
2) by purchasing a ticket through a mobile payment system using a mobile phone equipped with an active application,
3) in the form of subscription fees: monthly, 6-month, and 12-month, which entitle the holder to park in the SPP for the duration of their validity.
6. The detailed rules for the operation of the SPP are specified in the Regulations of the Paid Parking Zone.
7. The contractor is obliged to notify the Ordering Party in writing of their readiness to launch the SPP. The Ordering Party shall promptly set a date for the acceptance of the subject of the order after receiving notification.
8. The subject of the order includes, in particular:
a) organizing the Paid Parking Zone
b) equipping the SPP with no fewer than 30 parking meters necessary for the proper functioning of the SPP
c) creating, equipping, and running the Customer Service Office of the Paid Parking Zone
d) launching the systems for collecting parking fees using (free for users of the SPP) mobile payment systems compatible with the widely used operating systems, which will function in parallel with the system for collecting parking fees via parking meters.
e) enabling payments using contactless payment cards (at parking meters and in the Customer Service Office of the Paid Parking Zone). The costs of cashless payment services shall be borne by the Contractor.
f) insuring the subject of the contract for the benefit of the Municipality of Tuchola against theft of cash, constituting receipts from the SPP and damage that may occur related to certain random events and civil liability.
g) servicing paid unmonitored parking spaces in the SPP.
h) Technical and organizational activities related to collecting parking fees in the SPP, notifications, and all information regarding the subject of the order are included in attachment No. 1 to the SWZ and the contract template.
9. The Contractor must have the necessary knowledge, experience, and financial and technical resources required to execute the subject of the contract.
10. The services offered must meet the requirements of the Ordering Party described in the content of this SWZ and in the attachments to it and must comply with all applicable legal acts relevant to the subject of the order.
11. The Contractor, in executing this contract, shall exercise due diligence resulting from the professional nature of the services provided, which includes executing the subject of the contract.
12. The Ordering Party requires that activities directly related to the performance of the order be carried out by persons employed by the Contractor under an employment contract as understood by the Act of June 26, 1974 - Labor Code (Journal of Laws of 2025, item 277, as amended), unless they are carried out by the individuals personally as part of business activities carried out by them under registration with CEIDG. - providing the Ordering Party, at the latest on the day of signing the contract, with a document confirming that they are insured against civil liability concerning their business activities for a sum insured of at least 500,000.00 PLN, valid throughout the duration of the order,
- submitting a list of employees designated for the execution of the order along with a declaration that they are employed under an employment contract before starting to perform the subject of the order. The storage and transfer of funds to the Ordering Party's account shall be at the cost and risk of the Contractor.
