3.1. The subject of the order is the purchase of printing devices for the appellate courts of Poznań along with the provision of warranty services. The subject of the order includes an option referred to in Article 441 of the Public Procurement Law (Pzp). The subject of the order has been divided into 7 parts: 1) Part 1: Printer type 1 -2025/2 - mono. laser. A4 - group Printer type 1 -2025/2 - mono. laser. A4 in the amount of 155 units, option for 155 units, warranty min 36 months – parameter scoring in assessment criteria 2) Part 2: Printer type 7 -2025/2 - for printing case covers Printer type 7 -2025/2 - for printing case covers in the amount of 28 units, option for 28 units, warranty period – min. 24 months – parameter scoring in assessment criteria. 3) Part 3: Printer type 8 -2025/2 – for printing barcode labels with a guillotine Printer type 8 -2025/2 – for printing barcode labels with a guillotine in the amount of 22 units, option for 22 units, warranty period – min. 24 months – parameter scoring in assessment criteria. 4) Part 4: Printer type 9 -2025/2 – portable Printer type 9 -2025/2 – portable in the amount of 18 units, option for 18 units, warranty period – min. 24 months – parameter scoring in assessment criteria. 5) Part 5: Multifunction device type 1 -2025/2 -A4 mono Multifunction device type 1 -2025/2 -A4 mono in the amount of 60 units, option for 60 units, warranty period – min. 36 months – parameter scoring in assessment criteria. 6) Part 6: Multifunction device type 2 -2025/2 -A4 color Multifunction device type 2 -2025/2 -A4 color in the amount of 5 units, option for 5 units, warranty period – min. 36 months - parameter scoring in assessment criteria. 7) Part 7: Multifunction device type 4 -2025/2 -A3 color Multifunction device type 4 -2025/2 -A3 color in the amount of 13 units, option for 13 units, warranty period – min. 36 months - parameter scoring in assessment criteria. 2. The quantities of devices to be delivered under the order to specific locations broken down into individual parts along with delivery addresses are indicated in the Delivery List, which constitutes Appendix No. 5 to the SWZ. 4. Refers to: parts 1 – 6: The unit price for the offered equipment must be lower than 10,000.00 PLN gross. This results from the budgeting classification paragraph: 4210 limit of funds allocated for the implementation of this public procurement, offering a product with a price equal to or higher than 10,000.00 PLN gross will result in the rejection of the offer as non-compliant with the order conditions. 3.2 Option in accordance with Article 441(1) of the Pzp Act. According to Article 441(1) of the Pzp Act, the Ordering Party anticipates the possibility of exercising the option, and the Contractor expresses consent to this. The basis for activating the order regarding the option will be the real needs of the judiciary units and the guaranteed financial resources. The Ordering Party reserves that the part of the order designated as an option is a right, not an obligation of the Ordering Party. The implementation of the option may, but does not have to occur, depending on the demand of the Ordering Party and at their discretion in this regard. The lack of implementation of the order in the scope of the option will not generate any claims from the Contractor towards the Ordering Party. The Ordering Party may exercise the option once or multiple times, for one or several judiciary units in the scope of: Part 1: Printer type 1 -2025/2 - mono. laser. A4 - group in the amount of 155 units, Part 2: Printer type 7 -2025/2 - for printing case covers in the amount of 28 units, Part 3: Printer type 8 -2024/2 – for printing barcode labels with a guillotine in the amount of 22 units, Part 4: Printer type 9 – 2025/2 – portable in the amount of 18 units, Part 5: Multifunction device type 1 -2025/2 -A4 mono in the amount of 60 units, Part 6: Multifunction device type 2 -2025/2 -A4 color in the amount of 5 units, Part 7: Multifunction device type 4 -2025/2 -A3 color in the amount of 13 units. Delivery of devices within the option will be carried out to judicial units within the jurisdiction of Poznań, with the Ordering Party indicating the quantity and place of delivery. The Ordering Party anticipates the possibility of exercising the right of the option in accordance with the contract concluded, however, the notification referred to in item 8 will be sent to the Contractor no later than December 31, 2025. After the above-mentioned term, the option expires. The rules regarding the implementation of the subject of the contract covered by the option and changes to the contract regarding the implementation of the option will be the same as those applicable to the implementation of the basic order, subject to items 7 and 8. The unit price for the implementation of the option will be the same as during the realization of the basic order. The delivery time for the subject of the order under the right of the option: a maximum of 30 calendar days. The delivery time will be counted from the notification of the Contractor about the activation of the right of the option by the Ordering Party, in accordance with point 8. The Ordering Party is obliged to notify the Contractor of the activation of the option – the notification template constitutes Appendix No. 5 to the template contract by email to the Contractor's address.
