The procedure aims to acquire equipment within the framework of the Romanian Artificial Intelligence Hub Project – HRIA, code 334906. The procedure is divided into the following lots: LOT 1: HPC Equipment intended for intensive computation specific to artificial intelligence. LOT 2: Intelligent robotic system. LOT 3: BCI System.
The project is financed through the Smart Growth, Digitization, and Financial Instruments Program 2021-2027, Call code: PCIDIF/484/PCIDIF_P1/OP1/RSO1.1/PCIDIF_A2, Call Title: Support for 2 projects in the field of advanced technologies and the creation of innovation and technology transfer hubs in priority areas.
Note: *The contracting authority will respond clearly and completely to all requests for clarification/additional information 11 days before the deadline for submission of offers, provided that the requests are sent within the specified timeframe in Chapter I.1 (18 days before the deadline for submission of offers).
The award procedure/purchase is initiated under the incidence of this suspensive clause, in the sense that the conclusion of the public procurement contract is conditioned by obtaining financing through the financing contract of the project “Romanian Artificial Intelligence Hub – HRIA” financed from the Smart Growth, Digitization, and Financial Instruments Program 2021-2027, SMIS code 334906, with the contract being signed in compliance with the provisions regarding the commitment of expenses from budgets that fall under the incidence of public finance legislation. Given the provisions of Law 98/2016 and HG no. 395/2016 with subsequent amendments and completions, the Contracting Authority specifies that it will conclude the contract with the declared winning bidder only to the extent that the necessary funds for the acquisition are secured through the project “Romanian Artificial Intelligence Hub – HRIA” financed from the Smart Growth, Digitization, and Financial Instruments Program 2021-2027, SMIS code 334906. In case, regardless of the reasons, the Ministry of Investments and European Projects does not provide funding for the contract, the Contracting Authority, after receiving notification from the Ministry of Investments and European Projects regarding the non-provision of financing, reserves the right to cancel the award procedure, provided that there is no other source of financing, in accordance with the provisions of art. 212 para (1) lit. c) of Law 98/2016 with subsequent amendments and completions, the conclusion of the public procurement contract being impossible. Bidders in this procedure understand that the Contracting Authority and/or the Ministry of Investments and European Projects cannot be held liable for any damages in the event of cancellation of the award procedure, regardless of the nature thereof and whether the Contracting Authority and/or the Ministry of Investments and European Projects have been notified of the existence of such damage. Bidders in this procedure accept the use of the above special conditions/suspensive clause, assuming full responsibility with regard to any damages they might suffer in the described situation. The suspensive clause will operate for a maximum period of 6 months from the expiration of the contest period of the procedure results.
