Part No. 2: Network equipment, in accordance with the following specification: 7) Ethernet switch for AI computations - 4 pcs. 8) Border-leaf Ethernet switch - 2 pcs. 9) Ethernet mgmt switch - 3 pcs. 2. The subject of the order includes: 1) delivery of brand new Equipment to the Ordering Party; 2) provision by the Contractor of a warranty for the Equipment and ensuring warranty service and technical support for the delivered Equipment for a period of 60 months; 3) provision by the Contractor of Documentation for the delivered Equipment at the stage of delivery of the Equipment to the Ordering Party's headquarters; 4) installation and start-up of the delivered equipment at the Ordering Party's premises. 3. Detailed description of the subject of the order (hereinafter: SOPZ) is included in Annex No. 1 to the SWZ (common for both Parts) and in the Template Agreement, the template of which constitutes Annex No. 7 to the SWZ (hereinafter: Template Agreement or Agreement) - respectively for each of the two Parts.

The Ordering Party requires the Contractor to complete the description of the offered equipment in accordance with the requirements specified in Annex No. 2a to the SWZ - List of offered elements. The Ordering Party requires that the description of the offered assortment indicates the manufacturer/model/name or other data clearly identifying the offered equipment, and also clearly indicates the actual parameters of the offered equipment in the table. The description of the offered assortment is an integral part of the offer and cannot be supplemented. In the case of failure to submit a description of the offered equipment or failure to indicate data clearly identifying the offered equipment or its parameters, the Ordering Party will reject the offer on the basis of Article 226 paragraph 1 point 5 of the law. 4. In cases where trademarks, patents, origin, source, or specific processes characterizing products or services delivered by a specific Contractor have been indicated in the detailed description of the subject of the order, which would lead to the privileged treatment or elimination of certain contractors or products, it means that the Ordering Party cannot describe the subject of the order using sufficiently precise definitions and this is justified by the specificity of the subject of the order. In such situations, any references to trademarks, patents, origin, source, or specific processes should be read with the words 'or equivalent'. 5. In the event that references to norms, technical evaluations, technical specifications, and reference systems mentioned in Article 101 paragraph 1 point 2 and paragraph 3 of the Public Procurement Law have been applied in the description of the subject of the order, the Ordering Party, in accordance with Article 101 paragraph 4 of the Public Procurement Law, allows the use of equivalent solutions. Each time a norm, technical evaluation, technical specification, or specific reference technical system is specified in this SWZ, it should be understood that the phrase 'or equivalent' has been used concerning them. 6. The Contractor claiming equivalent solutions described by the Ordering Party is obliged to prove in the offer, in particular with the use of the subject evidence referred to in Articles 104-107 of the Public Procurement Law, that the solutions proposed by him meet the requirements specified in the description of the subject of the order to an equivalent degree. Evidence, in particular, the subject evidence referred to in Articles 104-107 of the Public Procurement Law, confirming that the solutions proposed by the Contractor meet the requirements specified in the description of the subject of the order to an equivalent degree are not subject to supplementation.
