The subject of the contract is the delivery and implementation of an IT/software system for the Department of Pathomorphology I and II and the Central Molecular Laboratory, Laboratory for the Study of HLA Antigen Matching at the Lower Silesian Oncology, Pulmonology and Hematology Center, along with installation, parameterization, configuration, and conducting training in the operation of the system, as well as maintenance services and author supervision under the project titled: Purchase of equipment for the oncological-pulmonological-hematological hospital in Wrocław in the area of AOS and day care services – STAGE I” No FEDS.05.01-IZ.00-0003/24, financed from the funds of the European Funds for Lower Silesia 2021-2027. The contract is financed from EU funds under the project titled: Purchase of equipment for the oncological-pulmonological-hematological hospital in Wrocław in the area of AOS and day care services – STAGE I” No FEDS.05.01-IZ.00-0003/24, funded from the European Funds for Lower Silesia 2021-2027 (partial funding). A detailed description of the subject of the contract referred to in point 3.1. is included in attachment No 1 to the SWZ - Description of the Subject of the Contract (OPZ), in attachment No 3 to the SWZ - Assortment and Price Sheet, and in attachment No 7 to the SWZ - Draft Agreement. I. The procedure is conducted in the mode of an open tender. II. Open procedure. III. The contracting authority does not allow for partial offers. The subject contract has not been divided into parts: Based on Article 91, paragraph 1 of the Act of September 11, 2019 – Public Procurement Law (Journal of Laws of 2024, item 1320, as amended), the contracting authority informs that it has not divided the contract into parts. This decision was made due to the integrated nature of the contract and the need to ensure functional and technological consistency of the entire IT solution. The subject of the contract constitutes a logical, functional, and technological whole, the effective implementation of which requires a uniform project, service, and integration approach. Dividing the contract into parts could: • threaten the integrity of the system and its compatibility with the existing HIS system – CGM, • hinder or prevent effective data transmission to the Electronic Medical Documentation (EDM), • increase the risk of integration errors and disperse responsibility among various contractors, • prolong the implementation time of the contract and increase its costs. Additionally, carrying out the contract by one contractor: 1. Ensures economic efficiency – allows for cost optimization, avoids duplication of administrative expenses, and simplifies supervision over the execution of the contract. 2. Enables unambiguous determination of responsibility – for quality, timeliness, and compliance with the contract. 3. Does not violate the principle of fair competition – The contracting authority has not identified any premises indicating that dividing the contract would bring benefits in terms of increased competition or easier access to the contract for smaller contractors. The contract pertains to a system that must operate as a unified IT platform, encompassing various organizational units, such as the Pathomorphology Department or Laboratories. Therefore, the lack of division of the contract into parts is justified and compliant with applicable legal regulations. IV. Market consultations were not conducted. V. The contract is planned. 6. Information on the reservation of the possibility to apply for the award of the contract only by Contractors referred to in Article 94 of the Pzp Act. - The contracting authority does not foresee any reservations in this regard. 7. Requirements concerning options - The contracting authority does not foresee the possibility of using options. The contracting authority does not anticipate settlements in foreign currencies. VII. The contracting authority reserves, in accordance with Article 139, paragraph 1 of the Act, that it may first evaluate the offers and then check whether the contractor whose offer was assessed as the most advantageous is not excluded and meets the conditions for participation in the procedure. VIII. 3.1. A detailed description of the subject of the contract referred to in point 3.1. is included in attachment No 1 to the SWZ – Description of the Subject of the Contract (OPZ), attachment No 3 - Assortment and Price Sheet, attachment No 7 to the SWZ - Draft Agreement. 6.1. To preliminarily confirm the absence of grounds for exclusion from the procedure and the fulfillment of the conditions for participation in the procedure, based on Article 125, paragraphs 1 and 2 of the pzp Act, the contractor submits, along with the offer signed with a qualified electronic signature, the following documents: 1. Completed and signed by persons authorized to represent the contractor: OPZ - attachment No 1 SWZ, Assortment and Price Sheet - attachment No 3 to the SWZ, offer form - attachment No 2 to the SWZ. 2. Current as of the date of offer submission statement in the form of a single procurement document (hereinafter: JEDZ) – a statement in the form of a Single European Procurement Document (hereinafter: JEDZ/single document), must be prepared under pain of nullity, in electronic form and signed with a qualified electronic signature – attachment No 4 to the SWZ. 3. Statements from the contractor/contractors jointly applying for the award of the contract regarding grounds for exclusion under Article 5k of Regulation 833/2014 and Article 7, paragraph 1 of the Act on special solutions for preventing supporting aggression against Ukraine and serving the protection of national security – the template of the statement is included in - attachment No 4a to the SWZ. 4. Statements from the entity providing resources regarding grounds for exclusion under Article 5k of Regulation 833/2014 and Article 7, paragraph 1 of the Act on special solutions for preventing supporting aggression against Ukraine and serving the protection of national security - attachment No 4b to the SWZ. 5. If the contractor relies on the abilities or situation of the entities providing resources, he/she presents, along with the statement referred to in point 2, also statements from the entity providing resources (attachment No 4b to the SWZ) confirming the absence of exclusion grounds for that entity and appropriately fulfilling the conditions for participation in the procedure. The template of the obligation of the entity providing resources to make available the necessary resources for the implementation of the contract (if applicable) is included in attachment No 8 to the SWZ. 6. In the case of contractors jointly applying for the award of the contract, the statements referred to in points 2 and 3 must be submitted by each contractor. These statements confirm the absence of grounds for exclusion and meeting the conditions for participation in the extent to which each contractor demonstrates meeting the conditions for participation in the procedure – the template of the statement is included in attachment No 9 to the SWZ. 7. Completed and signed by persons authorized to represent the contractor offer form (according to the document defining the legal status of the contractor or the power of attorney attached to the offer) attachment No 4 to the SWZ. 8. The original of the power of attorney or a copy confirmed as compliant with the original by the person issuing it or by a notary, if the person signing the offer is not authorized based on the document defining the legal status of the contractor. For this power of attorney, in accordance with Article 1, paragraph 1, point 2 of the Act of November 16, 2006 on stamp duty (i.e. Journal of Laws 2015 item 783 as amended), no fee is required. The power of attorney for submitting the offer must be submitted in original form, the same as the submitted offer (i.e. in electronic form signed with a qualified electronic signature). An electronic copy (scan) of the power of attorney drawn up beforehand in written form is also allowed, in the form of electronic certification made per Article 97 § 2 of the Act of February 14, 1991 – Notarial Law, which certification a notary places a qualified electronic signature on, or through affixing the qualified electronic signature of the grantor to the scan of the power of attorney drawn up beforehand in written form. The electronic copy of the power of attorney may not be authenticated by the authorized person.
