Acquisition of a "Digital Platform for Fleet Management and Maintenance". The duration of the sectorial product supply contract will be 12 months from the date of signing and will end after the completion of the award procedure for the product supply contract under the following condition: CLAUSE SUSPENSION - The conclusion of the contract is conditioned by the signing of the additional act amending the financing contract no. 45/13.12.2023 based on Note no. Sinv/1/174/23.04.2025, which approved the proposal to amend the financing contract no. 45/13.12.2023 for the Project of Modernization of 55 electric locomotives intended for hauling passenger trains, conversion of 20 hydraulic diesel shunting locomotives into electric locomotives with batteries, and modernization of 139 passenger cars, funded through the National Recovery and Resilience Plan Component 4 - Sustainable Transport, Annex no. 1 - Project Sheet. In case, regardless of the reasons, the financing contract no. 45/13.12.2023 is not amended through an additional act according to the provisions of Note no. Sinv/1/174/23.04.2025 within a maximum term of 60 days from the date of approval of the procedure report, the awarding procedure will be annulled by law according to the provisions of art. 225, para. (1) lit. c), second thesis of Law 99/2016 with subsequent amendments and completions, making it impossible to conclude the procurement contract. Bidders in this procedure understand that SNTFC "CFR Călători" S.A. cannot be held responsible for any damage in the event of cancellation of the awarding procedure, regardless of its nature and regardless of whether SNTFC "CFR Călători" S.A. was notified of the existence of such damage. Bidders in the procedure accept the use of the above special conditions/suspension clause, assuming full responsibility regarding any damages they may suffer in the described situation. The economic operator may request clarifications 18 days before the deadline established for the submission of offers, and the contracting entity will respond clearly and completely to all requests for clarifications/additional information 11 days before the deadline for submission of offers.
