3.1. The subject of the contract is the purchase of printing devices for the courts of the Poznań appeal along with the provision of warranty services. The subject of the contract includes an option referred to in Article 441 of the Public Procurement Law (Pzp). The subject of the contract has been divided into 7 parts: 1) Part 1: Printer type 1 -2025/2 - mono. laser. A4 - team printer Printer type 1 -2025/2 - mono. laser. A4 in the quantity of 155 units, option for 155 units, warranty min 36 months – a parameter scored in the evaluation criteria 2) Part 2: Printer type 7 -2025/2 - for printing case covers Printer type 7 -2025/2 - for printing case covers in the quantity of 28 units, option for 28 units, warranty period – min. 24 months – a parameter scored in the evaluation criteria. 3) Part 3: Printer type 8 -2025/2 – for printing barcodes with a guillotine Printer type 8 -2025/2 – for printing barcodes with a guillotine in the quantity of 22 units, option for 22 units, warranty period – min. 24 months – a parameter scored in the evaluation criteria. 4) Part 4: Printer type 9 -2025/2 – portable Printer type 9 -2025/2 – portable in the quantity of 18 units, option for 18 units, warranty period – min. 24 months – a parameter scored in the evaluation criteria. 5) Part 5: Multifunction device type 1 -2025/2 -A4 mono Multifunction device type 1 -2025/2 -A4 mono in the quantity of 60 units, option for 60 units, warranty period – min. 36 months – a parameter scored in the evaluation criteria. 6) Part 6: Multifunction device type 2 -2025/2 -A4 color Multifunction device type 2 -2025/2 -A4 color in the quantity of 5 units, option for 5 units, warranty period – min. 36 months - a parameter scored in the evaluation criteria. 7) Part 7: Multifunction device type 4 -2025/2 -A3 color Multifunction device type 4 -2025/2 -A3 color in the quantity of 13 units, option for 13 units, warranty period – min. 36 months - a parameter scored in the evaluation criteria. 2. A detailed description of the subject of the contract containing the technical specification divided into individual parts is specified in the Description of the subject of the contract (OPZ), which constitutes Annex 2 to the SWZ. 3. The quantities of devices delivered under the contract to individual locations broken down into individual parts along with delivery addresses are specified in the Delivery List, which constitutes Annex 5 to the SWZ. 4. Regarding: parts 1 – parts 6: The unit price for the offered equipment must be lower than PLN 10,000.00 gross. This follows from the classification budget paragraph 4210 limit of financial resources allocated for the implementation of this public procurement contract; offering a product with a price higher than or equal to PLN 10,000.00 gross will result in the rejection of the offer as inconsistent with the conditions of the contract. 3.2 The option according to Article 441 paragraph 1 of the Public Procurement Law. According to Article 441 paragraph 1 of the Public Procurement Law, the Ordering Party anticipates the possibility of utilizing the option, and the Contractor agrees to this. The basis for activating the order in the scope of the option will be the real needs of the judiciary units and guaranteed financial resources. The Ordering Party reserves that the part of the contract specified as an option is an entitlement and not an obligation of the Ordering Party. The realization of the option may, but does not have to, occur depending on the demand of the Ordering Party and on the basis of their disposition in this regard. The lack of realization of the order regarding the option will not give rise to any claims from the Contractor against the Ordering Party. The Ordering Party may utilize the option once or multiple times, for one or several judicial units in the scope of: Part 1: Printer type 1 -2025/2 - mono. laser. A4 - team printer in the quantity of 155 units, Part 2: Printer type 7 -2025/2 - for printing case covers in the quantity of 28 units, Part 3: Printer type 8 -2024/2 – for printing barcodes with a guillotine in the quantity of 22 units, Part 4: Printer type 9 –2025/2 – portable in the quantity of 18 units, Part 5: Multifunction device type 1 -2025/2 -A4 mono in the quantity of 60 units, Part 6: Multifunction device type 2 -2025/2 -A4 color in the quantity of 5 units, Part 7: Multifunction device type 4 -2025/2 -A3 color in the quantity of 13 units. Delivery of devices under the option will be carried out to the judiciary units in the Poznań appeal area, with the Ordering Party indicating the quantity and place of delivery. The Ordering Party anticipates the possibility of utilizing the right of option according to the concluded contract; however, the notification referred to in point 8 will be sent to the Contractor no later than December 31, 2025. After this date, the option expires. The rules regarding the execution of the subject of the contract covered by the option and changes to the contract regarding the execution of the option will be the same as those applicable to the execution of the primary contract, with the exception of points 7 and 8. The unit price during the execution of the option will be the same as during the execution of the primary contract. The delivery time of the subject of the contract under the option: a maximum of 30 calendar days. The delivery time will be counted from notifying the Contractor about the initiation of the right of option by the Ordering Party, in accordance with point 8. The Ordering Party commits to informing the Contractor about the realization of the right of option – the template of the notification constitutes Attachment 5 to the contract template via email to the Contractor's address.
