Procurement of development-associated evaluation services related to the development of an AI solution to support digital planning and approval processes.
The subject of the overall project underlying the procurement procedure is the development of an AI solution that aims to support administrative processing in complex planning and approval procedures. In this context, the contracting authority intends to concurrently invite bids for three contracts associated with the development of the AI solution:
- As part of the contract "Development of an AI Solution for Supporting Digital Planning and Approval Processes," the development and creation of an AI solution will be provided.
- As part of the contract "Digital Legal Methodology," a legal methodology will be developed, which will be made available to the contractor of the services "Development of an AI Solution for Supporting Digital Planning and Approval Processes" and must be taken into account by them during contract execution.
- As part of the contract "Evaluation," it is planned to conduct comprehensive support of the AI solution development from the contract "Development of an AI Solution for Supporting Digital Planning and Approval Processes" and to assess in particular whether the AI solution meets legal requirements, fulfills assigned tasks, adheres to ethical standards, etc.
The purpose of this tender is the development-associated evaluation services. The evaluation services include:
- Legal Evaluation: Verification of the correct application of legal methodological principles by the AI solution; in particular, consideration of the specific legal provisions, planning law, and specific legal requirements for the AI, data protection, and compliance.
- Organizational Evaluation: Impact of the AI solution on the administration. Consideration of the sovereignty of the administration, impacts on discretionary powers and legal application as well as on the uniformity of the legal system, the rule of law, and transparency.
- Procedural Evaluation: Verification of the operational functionality of the AI solution, the fulfillment of intended tasks, achievement of correct results; involvement of relevant stakeholders such as citizens, administration, expert authorities, and other process participants.
- Technical Evaluation: Assessment of the infrastructure, software, data management, data protection, and data security from a technical perspective. Examination of the interoperability of the AI solution (seamless integration into existing and future digital administrative structures).
- Ethical Evaluation: Integration of ethical issues, responsibilities of developers and users into the legal framework and methodological approaches, aim: ensuring responsible use of AI in the legal context.
The evaluation services are to be performed in a development-accompanying manner during the execution of the separately commissioned services "Development of an AI Solution for Supporting Digital Planning and Approval Processes." The services of the separate commissioning will be provided within the framework of an innovation partnership. The number of innovation partners, the process, and the specific interim goals of the development and service phases will be specified in the course of the procurement procedure for the innovation partnership with the respective innovation partners. The contracting authority will communicate the specified evaluation requirements to the contractor within the framework of each individual call-off. The maximum value of the framework agreement amounts to 1,422,000.00 EUR (gross!).
