The contracting authority is seeking to acquire 'Services and products (software and hardware) provided in the project "Digitalization of the Marius Nasta Pneumophthisiology Institute" – financing contract 1721/68/133/2024', through an open bidding procedure following which a supply contract will be concluded with the bidder declared as the winner. The contracting authority will respond clearly and completely to all requests for clarification on the 11th day before the established deadline for submitting offers, provided that they are submitted within the specified timeframe. The number of days during which clarifications can be requested before the deadline for submitting offers/applications is: 18 days.
Suspensive clause: The awarding of the public procurement contract is initiated under the incidence of this suspensive clause, in the sense that the conclusion of the public procurement contract is conditioned on the allocation of funds in the hospital's budget, according to the financing contract. Considering the provisions of Law no.98/2016 regarding public procurement and G.D. no. 395/2016, with subsequent amendments and completions, the contracting authority specifies that it will conclude the contract with the bidder declared as the winner only to the extent that the funds necessary for the procurement will be allocated in the hospital's budget. In the event that, for any reason, the funds are not approved, the awarding procedure will be automatically canceled, in accordance with the provisions of art. 212, para. (1), lit. c) second part of Law 98/2016 with subsequent modifications and completions, making it impossible to conclude the public procurement contract. Bidders in this procedure understand that the contracting authority cannot be held responsible for any damage in the event of cancellation of the awarding procedure, regardless of its nature and regardless of whether the contracting authority was notified of the existence of such damage. Bidders in this procedure accept the use of the above special conditions/suspensive clause, assuming full responsibility for any potential damages they may suffer in the described situation.

All equipment and facilities proposed to be acquired under this project must contain the latest and most innovative technologies available and must be compatible/fall within the existing workflows/systems at the Marius Nasta Pneumophthisiology Institute. Through this project acquisition, the general objective of the project is intended to be achieved, namely the improvement of the quality of health services, patient and staff safety and satisfaction within the medical unit, by modernizing IT systems and digital infrastructure (software, applications, and hardware). The contracting authority will respond clearly and completely to all requests for clarification on the 11th day before the established deadline for submitting offers, provided that they are submitted within the specified timeframe. The number of days during which clarifications can be requested before the deadline for submitting offers/applications is: 18 days.
