1. The subject of the order is a supply consisting of the purchase and implementation of software, including the implementation and integration of the HIS system, as well as the expansion of SSI, server infrastructure, and cybersecurity systems, related to the realization of the project “Development of Digital Services, Improvement of Data Security and Integration of Hospital Systems at the Independent Public Healthcare Facility in Pruszków”, with the possibility of submitting partial offers.

2. The contracting authority allows for the submission of partial offers.

3. The contract has been divided into 2 parts, namely:

4.1. Part No. 1 - implementation and integration of the HIS system. The subject of the order in this part involves comprehensive execution, consisting of the implementation and integration of the HIS system. The subject of the order, containing information about the required technical parameters, has been detailed in Appendix No. 2.1 to the SWZ - description of the subject of the order.

4.2. Part No. 2 - expansion of SSI, server infrastructure, and cybersecurity systems. The subject of the order in this part involves comprehensive execution, consisting of the expansion of SSI, server infrastructure, and cybersecurity systems. The subject of the order, containing information about the required technical parameters, has been detailed in Appendix No. 2.2 to the SWZ - description of the subject of the order.

4. The contracting authority allows the submission of offers for one, several, or all parts.

5. The subject of the order should be brand new and ready to work without any additional purchases and investments.

6. The subject of the order will be delivered at the cost, risk, and transport of the Contractor along with documentation in Polish, warranty conditions, and warranty card.

7. Delivery place: Independent Public Healthcare Facility in Pruszków, ul. Armii Krajowej 2/4, 05-800 Pruszków.

8. The subject of the order also includes all works and duties of the Contractor specified in the Draft Provisions of the Agreement.

9. The parameters presented in the detailed description of the subject of the order constitute the minimum technical and quality expectations of the Contracting Authority. Any indicated product names and their manufacturers are intended only to illustrate the requirements that could not be described using sufficiently accurate and understandable terms.

10. The contracting authority allows the delivery of equivalent equipment in relation to the description of the subject of the order, i.e., that the offered subject of the order will have the same or higher technical, quality, functional, and usability parameters.

11. The trademarks, proprietary names, etc. indicated in the description of the subject of the order (if any appear) constitute only a quality standard concerning the subject of the order. In all cases where, due to the specification of the subject of the order, material names are indicated, the use of equivalent materials is permitted, i.e., all materials mentioned by name used in the description of the subject of the order serve only to define the standard and may be replaced with others of no worse usability and quality parameters. The contracting authority, in the case of offers containing equivalent solutions, will verify them in terms of meeting the requirements of each item of technical requirements contained in the appendices to the SWZ. The Contractor is obliged to prove in the offer the equivalence of the offered assortment. The burden of proving equivalence is the responsibility of the Contractor. The contracting authority will not accept equivalent solutions if they do not meet the minimum quality requirements indicated in the appendices to the SWZ.

12. Any names of manufacturers included in the description of the subject of the order were used solely for illustrative purposes. Any indicated products and their manufacturers are not intended to violate the principle of fair competition and equal treatment of contractors. Wherever they are indicated, they should be read as accompanied by the term “or equivalent.” By the term “or equivalent,” the contracting authority understands the offering of materials that guarantee the execution of the order in accordance with the expectations of the contracting authority. The application of equivalent solutions may not lead to a deterioration of the properties of the subject of the order, nor to a change in price, nor to a violation of legal regulations.

13. In describing the subject of the order by reference to norms, technical evaluations, technical specifications and reference technical systems mentioned in Article 101, para. 1 point 2 and para. 3 of the Public Procurement Law, the contracting authority indicates that it allows solutions equivalent to those described, and such references are accompanied by the words “or equivalent.”

14. The subject of the order is being implemented as part of the project titled “Development of Digital Services, Improvement of Data Security and Integration of Hospital Systems at the Independent Public Healthcare Facility in Pruszków” under Investment D1.1.2 “Accelerating the processes of digital transformation in healthcare through the further development of digital services in healthcare” which is a part of Component D “Efficiency, Accessibility, and Quality of the Healthcare System” of the KPO.

15. The aim of the project is the comprehensive digitization of medical and administrative processes and the improvement of the functioning and quality of medical care provided by the Independent Public Healthcare Facility in Pruszków (1st level PSZ) through the implementation and integration of the provider’s information system (HIS) and the implementation of solutions that enhance the level of cybersecurity.

16. The conditions for the execution of the subject of the order are also included in the Draft Provisions of the Agreement, which constitute Appendix No. 8 to the SWZ.
