1. The subject of this order is the delivery of a brand new and free from legal and physical defects HPLC chromatograph with DAD, fluorescence, light scattering detectors, as well as with a flash system (set) along with equipment (hereinafter referred to as “Equipment”). Further information regarding the description of the Equipment and the scope of delivery is provided in the subsequent parts of the announcement (Description (BT-24-Lot), whereby full and exhaustive information in the indicated scope is provided by the SWZ. 2. Whenever the term used in this announcement is among those indicated below, it shall be understood as follows: 1) PZP Act - the Polish Act of September 11, 2019 – Public Procurement Law, 2) SWZ or Procurement Documents - the document prepared for this procedure (and the unrestricted tender procedure) which is the procurement document referred to in Articles 133 and 134 of the PZP Act with attachments, including Attachment No. 2 (Technical and scope description of the delivery) and the Draft Agreement; 3) Draft Agreement – the proposed terms of the agreement for the procurement, the content of which is provided in Attachment No. 9 of the SWZ.

Delivery of HPLC chromatograph with DAD, fluorescence, light scattering detectors, as well as with a flash system (set) along with equipment (hereinafter referred to as “Equipment”).
The description of the minimum technical requirements and other types of properties of the Equipment is provided in Attachment No. 2 of the SWZ. 2. The scope of the delivery subject to this order includes at least: 1) The sale and delivery of the offered Equipment to the place indicated in section 2.1.2 of the announcement (hereinafter referred to as the “Place of Equipment Delivery”); 2) Preparation for operation by the Ordering Party of the delivered Equipment, consisting of at least the assembly at the Place of Equipment Delivery and performing other appropriate installation activities of individual devices, components, and other physical elements, as well as (after completing the aforementioned assembly and installation activities) performing the first start-up for demonstration of its correct operation, as well as providing basic training for the Ordering Party's personnel (aimed at preparing these persons for the correct use and practical operation) of the Equipment offered and delivered to the Ordering Party under the execution of this order. The specific type and scope of activities included in the services mentioned above in this point and the manner of their execution is described in § 4 of the Draft Agreement 3) Providing the Ordering Party with a warranty for the Equipment, whereby it is required to grant a warranty for a period of no less than 24 months from the date of delivery of the Equipment to the Ordering Party (taking into account the additional provisions in this regard described in § 6 sec. 3 of the Draft Agreement). Exceptions to the obligation to provide a warranty as stated above are provided by the SWZ; 4) Ensuring the Ordering Party with appropriate licenses allowing the Ordering Party to legally use the offered software referred to in Attachment No. 2 of the SWZ and any other computer programs that – as components or attachments – are necessary to use the Equipment on the part of the Ordering Party or will be offered. A full, indefinite, minimum single-user license will be required; 5) Issuing to the Ordering Party: a) Documents referred to in § 5 sec. 1 of the Draft Agreement; b) Other documents if the offered Equipment, its manufacturer, or the Contractor, or legal regulations require possession of such documents for the use of the Equipment on the part of the Ordering Party (as the user). 3. The scope of this order (delivery) also includes additional services requiring execution on the part of the Contractor in the course of implementing the Procurement Agreement, at the stage after the delivery of the Equipment to the Ordering Party such as removing defects and providing other services for the Ordering Party in connection with the warranty granted for the offered or delivered Equipment. 4. Fully and in detail, the services constituting the scope of the delivery subject to this order indicated in points 2 and 3 above, as well as other terms of its implementation - include the provisions of the SWZ, especially the Draft Agreement.
