1. The subject of the contract is the purchase of a computing server for machine learning and deep learning for the Faculty of Mathematics at Wrocław University of Science and Technology.
2. Delivery location: Wrocław University of Science and Technology, Faculty of Mathematics, Hoene-Wrońskiego 13c, Wrocław, room 0.19.
3. A detailed description of the subject of the contract can be found in Attachment No. 3 to the SWZ – OPZ.
4. A detailed scope of execution of the subject of the contract, which is the anticipated provisions of the agreement regarding the public procurement, can be found in the template agreement, which is Attachment No. 2 to the SWZ.
5. The delivered subject of the contract must be brand new, not exposed to displays, complete, and operational. By the term “brand new,” it is meant that the subject of the contract is originally packaged, unused before the delivery date, except for the necessary use for testing its proper functioning after production. The subject of the contract must be free from any physical and legal defects and claims from third parties.
6. Delivery deadline: within 30 days from the date of signing the contract.
7. According to Article 257 of the Public Procurement Law, the Ordering Party reserves the right to annul the procedure if the funds intended to finance all or part of the contract have not been awarded.
8. The Ordering Party anticipates the application of the so-called reverse procedure, as mentioned in Article 139(1) of the Public Procurement Law, i.e. the Ordering Party will first examine and evaluate the offers, and then conduct the qualification of the Contractor whose offer was rated the highest, in terms of the lack of grounds for exclusion and meeting the conditions for participation in the proceedings.
9. The Contractor is bound by the offer from the day of the expiration of the deadline for submitting offers until 28/12/2025 (90 days).
10. The offer must consist of:
10.1. the Contractor's offer form – which is Attachment No. 1 to the SWZ (an interactive form available on the e-Procurement Platform, indicating in particular the bid price for the entire subject of the contract)
10.2. the declaration mentioned in Chapter VII point 1 of the SWZ - JEDZ - an interactive form available on the e-Procurement Platform
10.3. the declaration mentioned in Chapter VII point 1a of the SWZ - (as applicable) Declaration attachments No. 5.1 and 5.2 to the SWZ;
10.4. (if applicable) the commitment of the entity providing resources, mentioned in Chapter VII point 3.3 of the SWZ;
10.5. (if applicable) evidence of the reservation of information constituting business secrets according to Chapter X point 6;
10.6. document(s) indicating the right to sign the Offer according to Chapter X point 15 of the SWZ; (if applicable) appropriate power of attorney according to Chapter X point 16 of the SWZ;
10.7. (if applicable) Declaration of contractors jointly applying for the contract - in accordance with Article 117(4) of the Public Procurement Law;
10.8. an evidence document - technical specification - allowing to ascertain compliance with the requirements presented by the Ordering Party in Attachment No. 3 to the SWZ OPZ (along with any Information for Contractors).
The requirement to indicate “Name, type, model, manufacturer” does not constitute the evidence document.
According to Article 107 of the Public Procurement Law, if the Contractor has not submitted the required evidence documents or the submitted required documents are incomplete, the Ordering Party will call for their submission or completion within a specified time. This rule does not apply if the relevant evidence document serves to confirm compliance with the features or criteria set out in the offer evaluation criteria, i.e. the indication by the Contractor of information assessed in the offer evaluation criteria is not subject to completion/submission based on Article 107(3) of the Public Procurement Law, or despite the submission of the evidence document, the offer is subject to rejection, or there are grounds for annulment of the proceedings.
11. Only Contractors who are not subject to exclusion according to the conditions specified in Chapter VI of the SWZ, and meet the conditions for participation in the proceedings specified by the Ordering Party can apply for the contract.
12. Only Contractors who meet the conditions regarding:
12.1. ability to participate in economic activity
The Ordering Party does not impose a condition in this regard.
12.2. authorizations to run a specified economic or professional activity, if resulting from separate provisions
The Ordering Party does not impose a condition in this regard.
12.3. economic or financial situation
The Ordering Party does not impose a condition in this regard.
12.4. technical or professional ability
The Ordering Party does not impose a condition in this regard.
13. The Ordering Party does not require the submission of a bid bond.
