Description:
Delivery of essential elements and devices for the Area Traffic Control System and Variable Message Signs in the City of Łódź.

[Numbering in accordance with SWZ] 4.1. The subject of the contract is the delivery of elements and devices necessary for the operation of the Area Traffic Control System in the City of Łódź in accordance with the annex to the Regulation of the Minister of Infrastructure of July 3, 2003, on detailed technical conditions for road signs and signals and road safety devices and the conditions for their placement on roads (Journal of Laws of 2019, item 2311, as amended). 4.2. The contract has been divided into 2 parts: 4.2.1 Part 1 – Delivery of materials necessary for the operation of the Area Traffic Control System, 4.2.2 Part 2 – Delivery of materials necessary for the operation of Variable Message Signs (VMS) and Passenger Information Displays (TIP). 4.3. The Contractor may submit offers for all parts of the contract. 4.4. A detailed description of the subject of the contract is included in Attachments: no. 1a, 1aa and 1aaa to SWZ – for part 1, Attachments no. 1b, 1bb and 1bbb – for part 2 and in the contract template (identical for both parts of the proceedings) 6.1. DATE OF COMPLETION OF THE CONTRACT The contract should be executed within 6 months from the date of signing the contract for each part of the order, with the deadline for individual orders specified in § 1 section 2 of the contract template. 1. CONTRACTING AUTHORITY: City of Łódź – Roads and Transport Authority, ul. Tuwima 36, 90-002 Łódź covered by the actions of the Łódź City Hall as an entity executing tasks of the Central Contracting Authority in accordance with Art. 44 sec. 2 and Art. 49 of the Public Procurement Law CONDUCTING THE PROCEEDINGS: Public Procurement Department in the Organization Department of the City of Łódź, ul. ks. Ignacego Skorupki 21, 90-532 Łódź 16.7. According to Art. 257 of the Ppl, the Contracting Authority does not foresee the possibility of canceling this proceeding if the public funds that the Contracting Authority intended to allocate to finance the whole or part of the order have not been granted to it. 39. INFORMATION CLAUSE UNDER ART. 13 AND 14 GDPR 39.1 In accordance with Article 13 paragraphs 1 and 2 of the General Regulation on Data Protection of April 27, 2016 (Regulation of the European Parliament and the Council EU 2016/679 on the protection of natural persons in relation to the processing of personal data and the free movement of such data and repealing Directive 95/46/EC), we kindly inform you that: 39.1.1 The administrator of personal data is the President of the City of Łódź based in Łódź at ul. Piotrkowska 104, 90-926 Łódź, email: lckm@uml.lodz.pl. 39.1.2 The Administrator has appointed an inspector and a deputy data protection inspector, with whom you can contact via email iod@uml.lodz.pl. The data protection inspector and his deputy can be contacted in all matters concerning the processing of personal data by the City of Łódź and the exercise of rights related to data processing. 39.1.3 Providing personal data is a prerequisite for participating in the public procurement procedure. The general basis for data processing is Article 6 paragraph 1 letter b and c and Article 10 of the General Regulation. The detailed purposes of data processing have been indicated in the following regulations: 1) Act of September 11, 2019 – Public Procurement Law; 2) Act of April 23, 1964 – Civil Code; 3) Act of August 27, 2009 on public finances, 4) Act of September 29, 1994 on accounting. Your data will be processed for the purposes of: a) conducting the public procurement procedure and selecting the contractor; b) signing the contract; c) financial and accounting settlement. 39.1.4. Personal data may be shared with other entities authorized to receive them under applicable laws, i.e., based on articles 18 and 74 of the Public Procurement Law, experts with specialized knowledge in case of their appointment, as well as data recipients in terms of data protection regulations, i.e. entities providing postal, courier, IT, banking, insurance services, persons and entities interested in the conducted proceedings, as well as entities using the Public Information Bulletin, Public Procurement Bulletin, Competitiveness Database. In situations where the value of the order equals or exceeds the EU thresholds, data will be transmitted to the Publications Office of the European Union. Additionally, when the City of Łódź acts as an entity executing tasks of the central contracting authority, the data of the chosen contractor will be provided to the relevant municipal organizational unit for which the proceedings are conducted to conclude and settle the contract. Personal data will not be transferred to third countries. 39.1.5. Personal data will be processed, including stored for a period of 4 years, counting from January 1 of the year following the year in which the matter was completed, and subsequently, in accordance with the provisions of the Act of July 14, 1983 on the national archival resources and archives, for a period of 5 years, according to category B5, in the case of documentation of the proceeding and 10 years in connection with the concluded contract, according to the archival category B10, and in the case of a change in the archival category of the documentation for a period in accordance with the changed archival category of the documentation. In the case of orders funded from European funds or other sources than those from the budget of the European Union under separate provisions in this regard for up to 25 years. The continuation of the records is in the SWZ 40.1 The Contracting Authority does not foresee: 40.1.1. signing a framework agreement; 40.1.2. submitting variant offers; 40.1.3. settlements in foreign currencies; 40.1.4. electronic auctions; 40.1.5. reimbursement of costs of participation in the proceedings; 40.1.6. the requirement or possibility of submitting offers in the form of electronic catalogs or attaching electronic catalogs to the offer; 40.1.7. a site visit by the Contractor or checking by the Contractor the documents necessary for the execution of the order available on the spot at the Contracting Authority
