Section L. 6221-4 of the Transportation Code authorizes the Minister responsible for civil aviation to authorize organizations or persons to carry out certain screening missions in the field of aviation safety. The authorization, by an order of the Minister responsible for Civil Aviation dated 26.7.2016 as amended, of OSAC (Agency for Civil Aviation Safety) currently in charge of these missions expires on 31.12.2022. The purpose of this call for applications is to prepare the regulatory authorization of the organization to carry out these missions for a projected period of six years beginning on 1.1.2023 [further to VI.3.A)].
The missions will cover the following areas:
(a) a task of investigating, issuing, controlling, suspending and withdrawing authorisations on behalf of the DSAC, as part of the authority under European or national regulations. This mission is related to:
— maintenance of aircraft and associated equipment (maintenance workshops, combined continuing airworthiness organization, general aviation aircraft owners, mechanic training organizations, mechanic licences);
— Continued Airworthiness Management (Continuing Airworthiness Management Organizations, Combined Continuing Airworthiness Organization, General Aviation Aircraft Owners);
— the production of aircraft and associated equipment (manufacturers of aircraft or equipment);
— the certification and monitoring of airworthiness of aircraft, products, parts and aircraft equipment;
— monitoring the airworthiness status of the French aircraft fleet, including the development and implementation of the monitoring programme required under paragraph MB303 of Regulation (EU) No 1321/2014;
— the monitoring of technical events occurring in service;
— contribution to the state security program piloted by the DGAC;
(b) an expert mission comprising actions carried out at the request of the European Aviation Safety Agency (EASA) within the framework of a partnership agreement signed by the DGAC and to which the organisation contributes;
c) a monitoring mission for the benefit of other national authorities (FAA, ANAC...) to French bodies with foreign accreditations, within the framework of existing bilateral agreements between the EU (or France) and the countries concerned;
(d) a regulatory monitoring mission, expertise on draft regulatory developments and the development of user guides, as well as a mission to maintain data on French aircraft in accordance with the registration register maintained by the Minister responsible for civil aviation;
e) a safety promotion mission to users. The completion of these missions requires the availability of high-level specialists, capable of assessing regulatory compliance in the aforementioned areas of aircraft, products, parts and equipment, certified organizations and their personnel.
These tasks must be carried out by staff directly employed by the authorized body and may not, except for derogation, be subcontracted. The authorised body may be authorised by the DSAC to avail itself of its authorisation to develop a market for ancillary services for the benefit of third parties, subject to conditions to be defined in the authorization. DGAC owns the OSAC brand, the website made available to users, the documents, procedures, data and computer tools currently held by the authorized service provider to carry out the tasks for which it is authorized. These elements will be made available and transferred to the new Enabling Contract Holder. In order to carry out the above missions, the holder collects revenue from the royalties collected from users calculated on the basis of the interministerial decree in force, the remuneration for the services performed by the holder under the partnership agreement with EASA and the remuneration for services ordered by the DSAC.
