The supplier will deliver the products in the requested quantity to the premises of the contracting authority, having the characteristics/specifications included in the submitted and accepted offer, in compliance with the minimum requirements specified in the terms of reference. Delivery will be carried out by the supplier according to the deadline assumed in the technical proposal, but no later than the deadline requested in the terms of reference, which runs from the date of signing the supply contract.

Any request for clarifications must be submitted in SEAP (https://e-licitatie.ro/). Under the provisions of Article 160 of Law 98/2016, as amended by OUG 107/2017, interested economic operators must request clarifications or additional information regarding the award documentation at least 18 days before the deadline set for bid submission, and under Article 161 of Law 98/2016, as amended by OUG 107/2017, the contracting authority's response will be sent on the 11th day before the deadline set for submitting bids.

SUSPENSIVE CLAUSE - this public procurement contract award procedure is initiated under the following suspensive clause: the award of the public procurement contract is conditional on the allocation of budget credits for the 2026 budget year upon the approval of annual budget laws and rectifying laws, necessary for the purchases provided in the project, so that the completion of the award procedure by signing the supply contract is subject to the following condition:
- the signing of the contract is conditioned upon obtaining the budget credits from the Ministry of Public Finance through the Romanian Academy for carrying out the Project activities, with the signing of the contract being possible only if budget credits are ensured at a level that covers the expenses planned for the 2026 budget year, until the project's completion, including the commitments of the contracting authority by signing these contracts.
- if these budget credits requested by the contracting authority for the purchase of the products subject to the award procedure are not materialized within a maximum of 60 working days from the deadline for submitting bids, the Contracting Authority will apply the provisions of article 212 paragraph (1) letter c) second thesis of Law no. 98/2016, making it impossible to conclude the contract.
- Bidders in this procedure accept the use of the above suspensive condition, assuming full responsibility regarding any potential losses they might suffer in the described situation.
