Description:
Development of design documentation along with author's supervision for the construction and reconstruction of the tram network and reconstruction of the road system in Bydgoszcz. Part 1

1. The subject of the contract is a service, within the meaning of Article 7(28) of the PPL, consisting in the development of design documentation (architectural and construction design and technical designs) along with obtaining all required administrative decisions, including environmental conditions, on permission to implement a road investment with all necessary attachments or on building permits and performing author's supervision.

"Construction of a tram route along Solskiego Street on the section from Kujawskiego roundabout to Ks. Ignacego Skorupki Street, along with the construction of a tram terminus at Bielicka Street and reconstruction of the road system".

2. The subject of the contract is a service, within the meaning of Article 7(28) of the PPL, consisting in the development of design documentation (architectural and construction design and technical designs) together with obtaining all required administrative decisions, including environmental conditions, on permission to implement a road investment with all necessary attachments or on building permits and performing author's supervision for the task: Construction of a tram route along Solskiego Street on the section from the Kujawskiego roundabout to Ks. Ignacego Skorupki street, along with the construction of a tram terminus at Bielicka street and reconstruction of the road system.

A detailed description of the subject of the contract and the conditions for the performance of the contract are described in the draft provisions of the contract, constituting Annex 1 to the SWZ - model Agreement with attachments (common for both parts), including the description of the subject of the contract, constituting Annex No. 2 to the Agreement and in the template of the offer form constituting Annex No. 2 - I to the SWZ (separate for each part).

4. The Contracting Authority does not impose an absolute requirement to carry out an on-site inspection, but suggests that it be carried out in the interest of the Contractor without the participation of the Contracting Authority.

5. Pursuant to Article 95(1) of the Public Procurement Law, the contracting authority requires that the contractor or subcontractor during the performance of the contract (during the entire term of the contract) employs on the basis of an employment relationship within the meaning of the provisions of the Labour Code (Article 22 § 1), persons performing during the performance of the contract: Office activities, office services and secretarial services.

This requirement does not apply to: designers, persons performing geodetic services.

A detailed description of the requirements of the Contracting Authority in this respect is provided in the proposed provisions of the Agreement, which are annex No 1 to the SWZ.

6. The Contractor may entrust the performance of part of the contract to a subcontractor, taking into account the prohibition described in point V.11. SWZ.

In the scope of subcontracting, the provisions of Articles 462-465 of the Public Procurement Law shall apply.

The Contractor is obliged to indicate in the Offer and in the ESPD the parts of the contract (in % or material scope) whose performance it intends to entrust to subcontractors, and the names of any subcontractors, if they are already known. The lack of a contractor's statement in this respect will mean that the contractor intends to independently perform the entire contract. The contractor is responsible for the actions, shortcomings, negligence of the subcontractor, as for his actions.

7.The contracting authority provides for the possibility of awarding contracts referred to in Article 214(1)(7) of the Public Procurement Law within 3 years from the date of award of the basic contract, consisting in the repetition of similar services, if it has the financial means to perform them. On the occasion of the occurrence of the above-mentioned orders, a separate agreement will be concluded.
