4.1. The subject of this contract is the provision of a municipal waste management service, including waste collected at the Selective Municipal Waste Reservoir (PSZOK) from the territory of the municipality of Balse, in a way that ensures that adequate levels of recycling are achieved, preparation for re-entry use and recovery by other methods and limiting the mass of biodegradable municipal waste transferred to storage in accordance with the provisions of the Act of 13 September 1996 on the maintenance of cleanliness and order in municipalities (i.e., OJ 2021, item 888), the local plan Waste management and records of the draft Rules of Procedure and Purity in the territory of the municipality of Lyse.
4.1. 4.2. Subject of the order according to CPV:
90500000-2 Waste Services,
90514000-3 Waste Recycling Services,
90533000-2 Waste Management Services.
4.3. The scope of the contract includes the use of municipal waste in 2022 and 2023, broken down into the following fractions:
1. unsegregated (mixed) municipal waste mixed with ash code 20 03 01 in an estimated quantity of approximately 1,860,00 Mg;
2. biodegradable waste codes 20 02 01, 20 01 08 in an estimated quantity of approximately 88,00 Mg;
3. Paper and cardboard packs of paper and cardboard codes 20 01 01 01, 15 01 01 01 in an estimated quantity of approximately 4,00 Mg;
4. Plastics, plastic packaging codes 15 01 02, 20 01 39 in an estimated quantity of approximately 148,00 Mg;
5. Metals, metal packaging codes 15 01 04, 20 01 40 in an estimated quantity of approximately 78,00 Mg;
6. Glass packs of glass with codes 20 01 02, 15 01 07 in an estimated quantity of approximately 156,00 Mg.
4.4. How to provide the service:
4.4.1. in the case of processing mixed municipal waste, green waste and other biowaste, the contractor should have the status of a municipal installation in accordance with applicable law, including in particular in accordance with the Act of 13 September 1996 on maintenance of cleanliness and order in the municipalities (i.e. OJ of 2021, item 888) for: mechanical-biological waste treatment plant, bio-processing plant of biodegradable waste, storage of waste resulting from mechanical-biological processing of mixed waste municipal and residue from the sorting of waste. The processing of waste collected selectively including packaging waste cannot be carried out outside the installations and facilities of Article 30 (1) of the Waste Act of 14 December 2012 (OJ of 2021 item item 779 as amended), but these installations do not have to have the status of the status of the regional installation;
4.4.2. waste management is to be confirmed by a waste transfer card, understood in accordance with the Regulation of the Minister of the Environment of 25 April 2019 on model documents used for waste records (Journal of Laws 2019, item 819), hereinafter referred to as the “Charter transfer of waste” — transmitted to the Contracting Authority together with the VAT invoice for the month to which the card relates. The data on the card must be consistent with weight flourishes, confirming the time and weight of municipal waste accepted into the installation;
4.4.3. the estimated quantities of municipal waste indicated in the SWZ represent the expected quantity for the transmission of municipal waste in 2022 and 2023. The Contracting Authority reserves the right to reduce or increase the amount of waste transferred in relation to those indicated in point 4.3. The Contractor shall, in such a situation, be obliged to use less or more of the waste of the type concerned at the unit prices indicated in the tender;
4.4.4. if the contractor's municipal installation is not able to accept the waste from the territory of the municipality of Lysse, the contractor will have to indicate another municipal installation which will accept the waste at the expense of the contractor within the same time as provided for for their delivery to the municipal installation.
