The subject of the contract is the maintenance of road technical infrastructure, consisting in its ongoing maintenance of constant technical efficiency and replacement of damaged elements and devices with new ones or transferred by the Employer, in accordance with the Annex to the Regulation of the Minister of Infrastructure of 3.7.2003 on detailed technical conditions for road signs and signals as well as road safety devices and conditions for their placement on the roads (Journal of Laws of 2003, No. 220, item 2181, as amended) with the division into basic and additional maintenance.

A detailed description of the subject of the contract is contained in Volume II of the Terms of Reference "Description of the subject of the Order and Detailed Technical Specification" and in Volume III of the Terms of Reference - "Contract act form".

1. The subject of the contract is the maintenance of road technical infrastructure, consisting in its ongoing maintenance of constant technical efficiency and replacement of damaged elements and devices with new ones or handed over by the Employer, in accordance with the Annex to the Regulation of the Minister of Infrastructure of 3.7.2003 on detailed conditions technical for road signs and signals as well as road safety devices and conditions for their placement on roads (Journal of Laws of 2003, No. 220, item 2181 as amended) with the division into basic maintenance and additional maintenance.

A detailed description of the subject of the contract is contained in Volume II of the Terms of Reference "Description of the subject of the Order and Detailed Technical Specification" and in Volume III of the Terms of Reference - "Contract act form".

2. The awarding entity pursuant to art. 29 paragraph 3a of the Act requires that activities in the field of the contract, consisting of:

a) servicing means of transport for transporting equipment and other road technical infrastructure involved in the road marking process,

b) operating machines necessary to perform the subject of the contract,

c) securing the area during works

They will be performed by at least 14 people employed under an employment contract.

3. Requirements referred to in art. 29 paragraph 3a of the Act, regarding the employment by the Contractor or subcontractor under a contract of employment of persons performing the contract performance activities indicated by the Employer, are set out in point 2 above and in Volume III of the ToR - Contract Act Form.

The above requirements specify in particular:

a) the method of documenting the employment of persons referred to in art. 29 paragraph 3a of the Act,

b) the Awarding Entity's powers to control compliance of the contractor with the requirements referred to in art. 29 paragraph 3a of the Act and sanctions for failure to meet these requirements,

c) the type of activities necessary to perform the contract to which employment requirements relate, based on an employment contract by the contractor or subcontractor of the person performing the activities during the performance of the contract.

4. The Ordering Party reserves that wherever the content of the Description of the Object of the Order and the Detailed Technical Specification constituting the description of the object of the order have been indicated trademarks, patents or origin, sources or detailed processes that characterize products or services provided by a specific contractor - the Employer allows methods , materials, devices, systems, technologies etc. equivalent to those described in the description of the subject of the contract. It is allowed to offer any equivalent market equivalents with properties not worse than those indicated by the Employer.

The parameters of the indicated standard specify the minimum technical, operational, operational, quality and functional conditions to be met by the subject of the contract. Indicated trademarks, patents, brands or manufacturer's names or sources or specific processes indicating origin only specify the product class, methods, materials, devices, systems, technologies etc. The offer may include methods, materials, devices, systems, technologies etc. brands and manufacturers, however, with technical, qualitative and functional and functional parameters corresponding to the methods, materials, devices, systems, technologies etc. described in the ToR. In addition, the Employer emphasizes that equivalent methods, materials, devices, systems, technologies, etc. cannot be substitutes for methods, materials, devices, systems, technologies, etc. described in the description of the subject of the contract and the detailed technical specification by means of trademarks, patents , origin, source or particular process.

5. The Contractor is obliged to perform the subject of this contract in the period from the date of signing the contract, but not earlier than from 1/1/2019 to 31/12/2021.
