Description:
Delivery of components for the Battery Energy Storage System (BESS) with a target usable capacity of 840 MWh, including a guaranteed purchase of at least 600 MWh within 24 months.

The subject of the contract includes the delivery (without installation and commissioning) of components for the Battery Energy Storage System (BESS) with operational power and usable capacity according to Appendix No. 1a to the Terms of Reference ("List of BESS Projects"). The contractor will deliver complete, brand new devices, ready for efficient installation and commissioning by the contracting authority or a separate contractor, and will participate in the commissioning of the delivered BESS system – according to the Terms of Reference. The agreement will be valid for 36 months from its conclusion.
The detailed description of the subject of the contract consists of the following documents:
1) Description of the Subject of the Contract ("Terms of Reference")
2) List of BESS projects being Appendix No. 1a to the Terms of Reference
1. The contracting authority plans to implement deliveries of BESS systems with a total target usable capacity of 840 MWh, in various power/capacity configurations, in accordance with Appendix No. 1a to the Terms of Reference.
2. The contracting authority guarantees the placement of orders and the purchase of at least 600 MWh of usable capacity within 24 months from the date of conclusion of the contract in configurations resulting from the needs of the contracting authority and Appendix No. 1a to the Terms of Reference.
3. The contracting authority anticipates the possibility of exercising the option right in accordance with Art. 441 of the Public Procurement Law, increasing the scope of the contract by 240 MWh to the planned level of 840 MWh. The detailed manner of exercising the option right is described in the procurement documentation.
4. The contracting authority allows the possibility of granting advances to the contractor for the performance of the subject of the contract, in accordance with Art. 442 par. 1 of the Public Procurement Law. The total value of advances will not exceed 100% of the gross contractual remuneration. The detailed manner of granting advances is described in the procurement documentation.

The contracting authority reserves the right to exercise the option right (in whole or in part) in case the basic scope is exhausted during the term of the agreement, and purchasing additional quantities of the product is in the interest of the contracting authority and results from its current needs. The exercise of the option right does not apply to the contract concluded between Enea Ciepło sp. z o.o. as the contracting authority and the selected contractor. The contracting authority allows the possibility of granting advances to the contractor for the performance of the subject of the contract, in accordance with Art. 442 par. 1 of the Public Procurement Law. The total value of advances will not exceed 100% of the gross contractual remuneration. The detailed manner of granting advances is described in the procurement documentation.
