The bid price needs to be provided for the quantity planned for procurement for 12 months. The framework agreement concluded as a result of the procedure will record the framework amount based on the winning bid price, which will be determined as follows: Framework Amount = Total bid price (without quantity deviation and options) / 12 * duration of the contract (24 months).

Procurement of batteries for electric and metro trains under a purchase framework agreement. Total quantity (planned): 472 pcs/24 months. Details of the procurement are included in the Price Table and the Technical Description. The quantities specified in the Price Table have been determined based on previous usage experiences for a period of 12 months, known as empirical quantities. Empirical quantities have been provided for the justified evaluation of the bids to define the total bid price excluding VAT, and the quantities procured under the contract may differ from these empirical data. The bidder must submit their proposal with this knowledge. The contract annex will only specify the unit prices. The contracting authority commits to issuing orders worth 90% of the recorded framework amount in the framework agreement. The bidder must specify the manufacturer and manufacturer identification of the offered products in the Price Table. The bidder or the manufacturer of the offered products or the subcontractor must have a valid ISO 14001 certificate or an equivalent standard for an environmentally centered management system in operation at the manufacturer. If the bidder does not possess an ISO 14001 or equivalent standard for an environmentally centered management system, they must commit to obtaining the certification by the time of contract signing. The contracting authority reserves the right, in the event of doubts during the evaluation of the bids, to require the bidder to submit proof of the application of a valid ISO 14001 or an equivalent standard for an environmentally centered management system at the manufacturer, relevant to production, or a simple copy of a certificate proving the operation of a quality management or environmental management system accredited by any national system, or other proof of the application of the quality management or environmental management system (e.g., a screenshot of the valid ISO 14001 certification from the manufacturer's website). In the absence of this, an inspection report from an accredited testing laboratory no older than one year must be attached. If foreign language documents are submitted, a Hungarian translation must also be attached to the bid. The contracting authority draws attention to the provisions in Section 46 (3) of Government Decree 321/2015 (X. 30.). Batteries contain hazardous substances for the environment; therefore, the bidder must submit a safety data sheet in Hungarian according to the provisions of Act XXV of 2000 regarding chemical safety, as specified in the guidelines. The contracting authority reminds the bidder that they must attach a safety data sheet compliant with the requirements of EU Regulation 2020/878 and Regulation 1272/2008/EC! The bidder must declare in their bid, signed in company form, that: • the completion deadline, which cannot be less than 90 calendar days and cannot exceed 120 calendar days; • commits to performance in the quantities requested by the contracting authority according to the scheduled deadlines; • will ensure the products are of the specified quality and, if awarded, will deliver the items offered during the entire duration of the contract; • the manufacturer's logo/name will appear on the offered vehicle manufacturer's products or, if this is not possible, their packaging; • will deliver the offered vehicle manufacturer's products in their original manufacturer's packaging throughout the duration of the contract; • if the original manufacturer's packaging does not protect the goods against dust, water, and other contaminants, or any external damage during transportation and storage, they will provide the goods with suitable additional packaging; • the warranty period undertaken is at least 12 months from the product installation, without mileage limitation, and agrees to the conditions related to the warranty; • in case of failure during the warranty period, will compensate for damages arising from that failure; • will deliver the connection elements necessary for installation provided by the product manufacturer to the contracting authority free of charge upon delivery; • commits that the supplied products will not be older than 6 months from production, which must be proven with a factory code; • in the event of failure during the warranty period will replace the battery free of charge, if the fault cannot be repaired; • in case of product failure within the warranty period, upon exercising the warranty or in the case of defective performance, will pick up the product free of charge, and return the replaced product to the contracting authority; • will comply with the relevant standards, as well as occupational safety, fire protection, environmental protection, and other legal regulations during performance; • acknowledges and accepts all conditions stated in the invitation to submit a tender, procurement guidelines, and all their annexes, the draft contract, as well as any clarifications and additional information potentially provided by the contracting authority; • undertakes to enter into the contract and perform it against the remuneration specified in the bid; • acknowledges that the contracting authority will send orders exclusively by email, for which: o upon winning, will ensure that orders are received at a single email address, o if the contracting authority can prove the electronic sending of the order to the specified email address - at least with a delivery confirmation from the electronic mailing system - the order shall be deemed delivered; Continuation in the BT300 field
