1. The subject of the order is the delivery of two servers with parameters specified in Table No. 1 included in the Description of the subject of the order which constitutes Annex No. 1 to the SWZ.
2. The contractor will deliver two servers and all necessary materials, licenses, accessories, and cabling needed to connect and operate the supplied device as part of this procedure.
3. The place of delivery of the subject of the order is the building of the Marshal's Office of the Lublin Voivodeship at 4 Artur Grottgera Street in Lublin. The contractor will provide transport to the designated room.
4. The contract execution period – the subject of the contract must be delivered within 20/30/40* calendar days from the date of signing the contract.
* According to the information provided by the Contractor in the offer. (The execution time is one of the criteria for evaluating the offers).
5. All delivered components must be brand new, functional, free from any defects, and come from a legal distribution channel and must be covered by a manufacturer's warranty and service in the territory of the Republic of Poland. They must be produced no earlier than 6 months before the date of submitting the offer.
6. In the event of a hard drive failure in the device covered by active technical support, the damaged hard drive remains with the Ordering Party.
7. Device servicing will be carried out directly by the Manufacturer and/or in cooperation with the Authorized Service Partner of the Manufacturer.
8. The Description of the subject of the order, including the conditions and rules of order implementation, as well as the description of the equivalence of the offered devices, constitutes Annex No. 1 to the SWZ – Description of the Subject of the Order.
9. Detailed conditions for the implementation of the Agreement are included in the content of Annex No. 3 to the SWZ – Essential Provisions of the Agreement.
10. The Contractor guarantees and undertakes that the Ordering Party's use of the supplied Equipment will not violate the property copyrights of third parties, in particular, the Ordering Party must not be offered Equipment and software that is registered in manufacturers' databases as intended for sale or sold to another end customer.
11. The Contractor states that the offered Equipment on the date of signing the Equipment Acceptance Protocol cannot be intended by the manufacturer for discontinuation of production or sale.
12. The Contractor states that the delivered subject of the order is equipment purchased through the official sales channel of the manufacturer. The Ordering Party reserves the right to verify the above requirement with the representative of the offered solution's manufacturer.
13. The Contractor will provide the Ordering Party with a warranty for the subject of the agreement under the terms specified in Annex No. 3 to the SWZ – Essential Provisions of the Agreement and in the content of Annex No. 1 to the SWZ – Description of the Subject of the Order.
14. The warranty does not exclude, limit or suspend the rights of the Ordering Party resulting from the provisions of the law on warranty for defects. The Ordering Party is entitled to exercise rights under warranty for defects, regardless of the rights under the warranty.
15. If the order documents indicate trademarks, patents, or origin regarding certain materials or devices, the Ordering Party allows, in accordance with Article 99 (5) of the Pzp, the offering of equivalent materials or devices. Materials or devices from specific manufacturers determine the minimum quality parameters, functional characteristics, that the materials or devices offered by the Contractor must meet to fulfill the requirements set by the Ordering Party. Materials and devices from specific manufacturers constitute only a qualitative benchmark for the subject of the order. By the term “minimum quality parameters and functional characteristics,” the Ordering Party understands the requirements for materials or devices contained in generally available sources, catalogs, manufacturers' websites. Using sample names of the manufacturer aims to clarify the level of expectations of the Ordering Party regarding a specific solution. The use of product/manufacturer names is only exemplary. By designating a specific manufacturer (supplier) or a specific product in the description of the subject of the order, the Ordering Party concurrently allows equivalent products with functional parameters and quality characteristics at least at the level of the indicated product parameters, thus recognizing any product with the indicated or better parameters.
16. In every case when the Ordering Party describes the subject of the order by referring to standards, European technical assessments, approvals, technical specifications and systems of technical reference, equivalent solutions described are permitted.
17. In every case of using a specific label or certificate specified in Articles 104 and 105 of the Pzp in the SWZ or order documents, the Ordering Party also accepts all other markings confirming that the construction works, supplies or services meet equivalent requirements.
18. In cases where the Contractor for reasons beyond its control, is unable to obtain the label or certificate specified by the Ordering Party confirming that the construction works, supplies or services offered by it meet equivalent requirements, the Ordering Party within the time period assigned by itself, accepts other evidence, in particular, the manufacturer's technical documentation, provided that the Contractor proves that the works, supplies or services offered by it meet the requirements of the specified marking or specific requirements indicated by the Ordering Party.
