1. The subject of the order is the "Purchase and delivery of medical equipment" as part of the Project titled "Strengthening the diagnostic potential of SPZZOZ in Staszów in order to improve access to cardiology care", co-financed under the National Recovery and Resilience Plan - Component D Investment D 1.1.1 "Development and modernization of the infrastructure of high-specialty care centers and other medical entities in the field of cardiology of centers qualified for OK I".
2. The subject of the order must meet the requirements of the principle of "do no significant harm" (DNSH - Do No Significant Harm), in accordance with Article 17 of Regulation (EU) 2020/852 of June 18, 2020. This principle applies in connection with the financing of the order under the National Recovery and Resilience Plan (KPO). The DNSH principle means that at no stage of the order's implementation - from production through delivery, use, to possible disposal - can there be serious harm to EU environmental objectives, namely: 1. Mitigation of climate change, 2. Adaptation to climate change, 3. Sustainable management of water and marine resources, 4. Circular economy (GOZ), 5. Prevention and control of pollution, 6. Protection of biodiversity and ecosystems.
3. The scope of the order includes delivery, assembly with the required installations (possible adjustments of the room if necessary) along with commissioning and training of the Ordering Party's staff.
4. The goods offered by the Contractor must:
a) Have valid documents allowing them to be marketed in the territory of the Republic of Poland in accordance with the relevant provisions of the applicable Act of April 7, 2022, on medical devices and the classification method based on the Regulation of the Minister of Health of November 5, 2010, on the method of classifying medical devices - if applicable to the given device.
b) Meet the requirements specified by the Ordering Party in the Terms of Reference, in particular the conditions specified in the description of the subject of the order - attachments with the required technical parameters.
c) Be brand new, fully functional, not refurbished, not demo version.
d) Be produced no earlier than 2025,
e) Meet quality and technical standards resulting from its function and purpose,
f) Be free from material, construction, physical and legal defects,
g) Not be encumbered with any rights in favor of third parties.
5. The offered Subject of the Order must be complete with all components, parts, and materials necessary for commissioning and use. The offered subject of the order must meet the Ordering Party's requirements.
6. The description of the offered product should leave no doubts for the Ordering Party. It should be clear from the description that the offered subject of the order has the same parameters required by the Ordering Party or better, by precisely indicating the parameters of the offered equipment.
7. A detailed description of the subject of the order is included in this Terms of Reference and:
