Maintenance of the park greenery of the Ursynów District - divided into tasks, with a detailed description of the subject of the contract specified by:
a) Task 1. Park by the Pheasantry
Description and technical standards of the performance of the subject of the contract - Annex No. 1a to the SWZ;
draft provisions of the agreement constituting Annex 6a to the SWZ;
Price form constituting Annex 2a to SWZ;
2) Obligations under the social clause
1. The contracting authority in the proceedings in question applies the social clause pursuant to Article 95(1) of the Act of 11 September 2019. Public procurement law.
2. The Contractor undertakes that the activities in the field of performance of the contract for services, during the entire period of performance of the subject of the contract, will be performed by persons employed on the basis of an employment contract within the meaning of the Labor Code by the Contractor or Subcontractor.
3. The condition referred to in paragraph 2 shall be met by employing new employees on the basis of an employment contract or by appointing already employed persons to perform the contract, performing the following activities during the performance of the contract, i.e. cleaning and gardening works.
3. The method of documenting the employment of persons under an employment contract within the meaning of the Labour Code referred to above entitles the Contracting Authority to control compliance by the Contractor or subcontractor with the requirements resulting from the application of the social clause and sanctions for non-compliance with these requirements are specified in the draft provisions of the contract constituting Annex 7a to the SWZ for Task 1.
