The subject of the contract is the provision of services including the performance of investment replacement activities for the task implemented in the “design and build” formula: “Modernization of school and kindergarten substances within the framework of the program School anew — stage II”, in terms of overhaul and adaptation building located at 34 Reymonta Street, plot no. 97/1 within 39 Podgórze in Wałbrzych, for the purpose of the establishment of the Local Government Nursery, in accordance with the Functional and Utilities Programme and then the Design Documentation, the construction permit/notification of the intention to carry out construction works, SWZ and contracts concluded by the Contracting Authority with Contractors and Co-Financing Institutions in accordance with applicable law, i.e. comprehensive legal, financial and technical services Tasks, settlement of funds allocated by the Contracting Authority for its implementation, and cooperation with implementation of contracts for subsidisation of Tasks.

Scope rb provided for execution:

(a) preparatory, including caring for tree cuts, demolition work,

(b) reconstruction and renovation of the building in the field of works, works of sanit installations, electrical and teletechn works,

c) modernization of the heating system of the boiler room with heat pumps,

d) catering kitchen equipment,

e) landscaping, including site fencing, hardening of the site, the execution of playgrounds with the installation of equipment, retaining walls, solid waste collection site, green areas, small architecture (benches + trash cans),

f) land armament (water connection, sanitary sewer network, rainwater drainage network, rainwater tank, teletechn sewer network),

(g) other resulting from the PFU and the need to adapt the facility to the applicable law.

4.The responsibilities of IZ will include:

1.Administering contracts with Works Contractors.

2.Cooperation with Zam. in the implementation of contracts with co-financing institutions

3.Fulfilling in replacement of the Contracting Party all obligations arising from the implementation of the Task, as defined in the provisions of Polish law, and in particular the Pb with implementing acts.

4.Representing the Contracting Authority during the period of implementation of the Agreement to the authorities, offices, courts, partners Tasks and other institutions, including carrying out the activities provided for in obtaining the required licences, decisions, notifications, opinions and approvals.

5.Full-industry investor supervision in accordance with Article 25 Pb:

(a) representing the Contracting Authority on the construction site by controlling the conformity of its implementation with the project and construction permit, regulations and techn knowledge principles,

(b) checking the quality of works performed and built-in construction products, and in particular the prevention of the use of defective and non-authorised construction products in construction,

(c) checking and acceptance of works that are covered or disappearing, participating in tests and acceptances of technical installations, technical equipment and preparing and participating in the activities of the final receipt of Works and carrying out all the activities related to the transfer of them for use,

(d) confirmation of the works actually executed and the removal of defects, as well as, controlling the financial settlements of the Works,

(e) issuing commands to the construction manager and/or the managers of works, confirmed by an entry in the construction log, concerning: removal of irregularities or hazards, the execution of tests or tests, also requiring the discovery of Works or covered elements, and to provide expertise on carried out Works and evidence of admission for use in construction of construction products and technical equipment,

(f) request from the construction manager and/or the managers of works to make amendments or re-execute defectively executed Works, as well as requesting a halt to further Works in the event that their continuation could cause a threat or cause unacceptable incompatibility with the project or permit for construction.

5.Cooperation with Designers within the framework of authorial supervision.

1.Keeping records of expenditures and settling Tasks.

2.The performance of the IZ obligations in the period prior to the implementation of the construction specified in §4 of the PPU

3. The performance of the IZ duties during the construction period specified in §5 of the PPU.

4.The performance of IZ obligations related to the reception of Works and transfer to use as specified in § 6 of the PPU

5.The performance of the obligations of the IZ during the warranty period for defects resulting from contracts concluded by the Contracting Authority with the Contractors of Works specified in §7 of the PPU

6.Fulfillment of IZ's responsibilities in the field of financial servicing and arising out of contracts concluded by co-financing institutions

7.Cooperation in possible investigation and enforcement from participants participating in the implementation of the Task, damages or contractual penalties for improper or untimely performance.
