The subject of the contract is: The supply of electricity to Silesian OW NFZ facilities, in accordance with the SWZ, including under the terms specified in the form description of the subject matter of the contract and in the proposed provisions of the contract annexed to the SWZ. “The Contractor should submit a declaration that it has a signed contract with the Distribution System Operator in the area where the places of electricity supply are located. The contents of the statement can be found in the form a description of the subject matter In the area of the Contracting Authority, the Distribution System Operator is Tauron Distribution S.A.

” The Contractor should account for electricity 24/7, despite the tariff groups B23, C11, C21.

” The Contractor should provide quality standards of service to customers in accordance with the provisions of the Law of 10 April 1997 Energy Law (i.e. Journal of Laws of 2021 item 716 as amended) and the implementing acts thereof, as well as Polish Standards, subject to the provisions contained in the designed the provisions of the contract.

“The Contractor shall fulfil the order in accordance with the provisions of the SWZ and applicable law, in particular in accordance with:

(a) By Act of 10 April 1997, Energy Law (i.e., OJ of 2021, item 716, as amended),

(b) Regulation of the Minister of Economy of 6 March 2019 on detailed rules for the formation and calculation of tariffs and settlements in the trading of electricity (i.e., OJ of 2019 item 503),

(c) The quality standards of service to the recipient, which are set out in the provisions in force on the basis of energy law.

In the event that the Contractor fails to comply with qualitative standards of service, the Contracting Authority will be entitled to the rates set out in §42 of the Regulation of the Minister of Economy of 6 March 2019 on detailed rules for the formation and calculation of tariffs and settlements in the trade electricity (i.e., OJ of 2019, item 503), subject to the provisions of the contract (the proposed provisions of the contract).

(d) By Law of 11 September 2019, the Law of Public Procurement (i.e., Journal of Laws of 2021, item 1129, as amended),

(e) Civil Code (i.e. Journal of Laws of 2020, item 1740, as amended) by the Act of 23 April 1964.

Subcontracting issues are described by SWZ.

Duration of execution of the order: for a period of 10 months, not more than 31.12.2022, counting from the date of actual commencement of electricity supply under the contract concluded as a result of the award of the contract in question. The actual start of the supply of electricity will occur after termination of the contract with the Reserve Seller and after the procedure for changing the seller, in accordance with the applicable provisions of the law. Starting from 01.01.2022, the Ordering Party will have concluded an agreement for the supply of electricity with the Reserve Seller
