The subject of the contract is: Supervising the design and implementation of Works and managing the Contract entitled: "Construction of the bypass of Gąski along the national road No. 65".

1. The subject of the order is:

Supervising the design and implementation of Works and managing the Contract entitled: "Construction of the bypass of Gąski along the national road No. 65" under the conditions specified in the Agreement with the Consultant and in accordance with the Contract Conditions for each Part of the investment task.

The service includes fulfilling the Consultant's obligations in accordance with the contract, based on GTC and SWK, in particular:

- supervision of the design, verification of the design documentation, its completeness, reciprocal compliance, verification of the results of conducting control calculations in order to find possible errors,

- management, fulfilment of investor supervision and control over the implementation of Works until the date of issue of the Final Payment Certificate,

- conducting information and promotional activities related to the implementation of the project and cooperation in this respect with the Contracting Authority, including the Branch Director, Project Manager and communication position in the GDDKiA Branch,

- fulfilling reporting obligations resulting from EU procedures and cooperation in this respect with GDDKiA services,

- fulfilling the obligations resulting from the procedures contained in the applicable requirements/guidelines for investments co-financed from EU funds and the procedures of the beneficiary of Projects for the Operational Programme Infrastructure and Environment or procedures that will be applied in the next EU perspective,

- providing an investor supervision service for the implementation of construction works and participation in the Guarantee Reviews and supervising the removal of any faults/defects identified in the warranty reviews within the framework of the concluded Contract,

- performing tasks taking into account the requirements and guidelines of the Operational Programme Infrastructure and Environment or procedures that will be applied in the next EU perspective,

- supporting the Ordering Party as a loyal and conscientious advisor in all activities related to the implementation of the Project,

- supervision of project work and robots in the field of additional tasks necessary for the implementation of the Project resulting in the implementation of the Contract - awarded under the Public Procurement Law Act,

- constant monitoring, handling and settlement of matters related to proper performance by individual Contractors, Contractor documents and works at the junction of adjacent Contracts and close cooperation with Consultant Teams supervising neighbouring investments - in result of which the Consultant will have the obligation to work out the rules and manner of proper execution of the Contractor's documents and works. If necessary, the Leading Consultant conducting the coordination case at the junction of the Projects shall appoint the Contracting Authority.

The Consultant Team will be headed by a Contract Engineer. He will act in accordance with the role assigned to the Engineer in the above-mentioned FIDIC Conditions of Contract and in the SWK, within the scope of rights specified in this Specification of the Conditions of Contract (SWZ) and resulting from the current provisions of the Construction Law, legal acts and guidelines governing the spending of EU Funds.

As part of the Service, the Consultant should ensure supervision over the implementation of design works and works in accordance with the Contract, in particular regarding the quality of works, ensuring proper future functioning and operation of facilities by the Ordering Party, acceptance of works, coordination of all activities related to the implementation of the Contract up to the final settlement of the Contract.
