Description:
Purchase ITSM software support and maintenance services

The subject of the contract is the purchase of ITSM software technical assistance and maintenance services.

The subject of the contract is the purchase of ITSM software technical assistance and maintenance services. As part of the service provided, the Contractor will provide:

a) access to a dedicated package of 200 programming hours in order to implement/adapt the system during the service provision,

b) support of a dedicated technical consultant in the amount of 100 hours for the period of service provision.

The Ordering Party allows to offer a subscription to software equivalent to that compliant with the technical specification of Annex 5 to the PPU – Chapter II SWZ. If the Contractor offers an equivalent solution, the Contractor:

a) together with the offer, demonstrates that the offered equivalent solution meets the requirements specified by the Contracting Authority in Annex 5 to the PPU – Chapter II SWZ, in particular by presenting the Contracting Authority with relevant documentation of the equivalent solution,

b) present together with the offer the provisions of the subscription service of the equivalent solution,

c) together with the offer, present a detailed technical design of the equivalent solution together with the installation, configuration and operating instructions for the offered solution,

d) at the stage of evaluation of offers, the Contracting Authority reserves the right to verify the proposed solution offered by the Contractor. For this purpose, at the request of the Contracting Entity, the Contractor, on its own equipment, at its own expense, will launch a test environment to verify compliance with the requirements set by the Ordering Party,

e) The Contractor is obliged to include in the offer all costs of its implementation at the Contracting Authority, including the costs of data migration, and will also cover all documented costs on the part of the Contracting Authority related to the implementation of an equivalent solution.

If the equivalent solution is chosen, the Contractor shall provide a document from the Manufacturer of the equivalent solution, confirming that after the end of the contract, the Contracting Authority, without time limits, has the right to continue using the software specified in Annex 7 to the PPU – Chapter II SWZ, without the Manufacturer's support.

The subject of the contract must be carried out by the Contractor authorized by the manufacturer or distributor or official partner of the software in question to legally sell the service being the subject of the order or subscription of equivalent software in the Republic of Poland.

If an equivalent solution is offered, the Contractor is obliged to demonstrate in the offer that the proposed solution meets the equivalence criteria to the extent indicated in Annex 5 to the PPU – Chapter II SWZ. For this purpose, the Contractor is obliged to attach to the offer the documents indicated above, containing data that will enable confirmation of equivalence. The Contracting Authority allows the Contractor to indicate a network address (link) under which the Contracting entity will gain access to the above-mentioned documents.
