The subject of the contract is the reception service by the Contractor of waste code 19 12 12 from 12 to 12 from mechanical waste treatment installations, hereinafter referred to as the Specification of the Conditions for the Contracting of ballast waste, in the amount of 4,000 Mg for the purpose of their use, in accordance with the decisions held by the Contractor.
The subject of the contract is the reception service by the Contractor of waste code 19 12 12 from 12 to 12 from mechanical waste treatment installations, hereinafter referred to as the Specification of the Conditions for the Contracting of ballast waste, in the amount of 4,000 Mg for the purpose of their use, in accordance with the decisions held by the Contractor.
1) Type of waste
Waste is residues after sorting mixed municipal waste and fractions selectively collected from plastics and paper, stripped of:
(a) a subsieve fraction up to 80 mm constituting an input into the biological process of waste processing;
(b) raw materials of plastics sorted with an optopneumatic device;
(c) waste from scrap ferrous and non-ferrous metals sorted with ferrous and non-ferrous metal separators;
(d) packaging of carton sorted by hand from a fraction of pop. 260 mm.
2) Method of execution of the order:
(a) Ballast waste shall be prepared by the Ordering Party in a loose form.
(b) Reception of ballast waste will take place from the site of the Waste Management Plant in Zakurzewo near Grudziądz.
(c) Receipt of waste shall be carried out by vehicles at the disposal of the Contractor, at his expense, including the costs of carriage, insurance for the duration of transport and unloading, in accordance with the provisions of the Act of 14 December 2012 on waste (Journal of Laws of 2021, item 779, as amended), of the Act of 20 June 1997 Traffic Law (Journal of Laws of 2021, item 450, as amended) and the Law of 6 September 2001 on Road Transport (Journal of Laws of 2021, item 919, as amended).
(d) The load of waste on vehicles substituted by the Contractor shall be carried out by the Ordering Party using a VOLVO 110G or VOLVO 110H wheeled loader at the site designated for this purpose in Zakurzewo Waste Management Department near Grudziądz.
(e) The Contractor shall receive the waste on an ongoing basis, on all working days, i.e. Monday to Friday, excluding holidays, from 7:00 to 14:00.
(f) The Contractor shall, at the time of execution of the contract, be obliged to comply with the rules of organisation of traffic in force at the Waste Management Department and to apply the recommendations of the Ordering Party personnel to carry out the loading of waste.
(g) The maximum daily amount of waste provided for receipt by the Contractor shall be 50 Mg.
(h) The Contracting Authority stipulates that the quantity of waste referred to above is an estimated quantity and may therefore be reduced, provided that the Contracting Authority guarantees that at least 80% of the total amount of ballast waste referred to abovementioned. the Contractor's failure to implement the estimated quantity in its entirety, subject to the guaranteed quantity, the Contractors shall not be entitled to any claim.
(i) The waste collected by the Contractor shall be weighted on the car weight located on the territory of the Waste Management Plant in Zakurzewo. In order to determine the weight of the waste received, the Contractor's vehicle must also be weighed before entering the area indicated above.
(j) Upon transfer of the waste by the Contracting Authority to the Contractor, the Contractor shall assume responsibility for the waste seized, for the due handling of it and the effects therefrom.
(k) The Contractor shall be solely liable for any damage, as well as for loss, defects and damage to waste arising during carriage and during the unloading of waste, unless they arise solely for reasons culpable by the Contracting Authority. The Contractor shall, in particular, be responsible for the actions, omissions of its personnel and carriers.
