Comprehensive supply of high-methane natural gas Type E to the buildings of the Municipality of Mogilany and its organizational units

1. The subject of the proceedings is the "Comprehensive supply of high-methane natural gas type E to the buildings of the Municipality of Mogilany and its organizational units".

2. Comprehensive gas supply will take place on the basis of an agreement containing the provisions of the sales contract and the contract for the provision of gas transmission or distribution services (comprehensive agreement) and will be performed in accordance with the provisions of the Energy Law (i.e. Journal of Laws of 2022.1385), hereinafter referred to as the Energy Law, the Civil Code (i.e. Journal of Laws 2022.1360) and the implementing regulations issued on their basis.

3. The estimated demand for natural gas in the period from 01.01.2023 to 31.12.2023 shall be 3 156 729 kWh. The above value is an estimate, given in order to determine the value of the contract, which does not reflect the real or declared consumption of natural gas during the term of the contract and in no case can be the basis for any claims on the part of the Contractor. The Ordering Party reserves the right to reduce or increase the amount of gas. The current operator of the Distribution System is Polska Spółka Gazownictwa Sp. z o.o.

4. The costs of using the subject of the Order will consist of: a fee for the sale of gas, a subscription fee, a fixed distribution fee and a variable distribution fee. The customer is qualified by the distribution system (DSO) competent for him to tariff groups with the designations W-1.1, W-2.1., W-3.12, W-3.6., W-4.,
