The subject of the contract is the sale (delivery) carried out in the SPOT exchange model and the purchase of electricity collection from RES in accordance with applicable regulations, in particular the provisions of the Regulation of the Minister of Climate and Environment of 22 March 2023 on the detailed conditions for the operation of the power system (Journal of Laws of 2023, item 819) to the Ordering Party's collection points. Energy will be consumed for the needs of the Ordering Party, which is an energy company within the meaning of the Energy Law of 10 April 1997 (consolidated text: Journal of Laws of 2022, item 1385, as amended)
The subject of the contract is the sale (delivery) carried out in the SPOT exchange model and the purchase of electricity collection from RES in accordance with applicable regulations, in particular the provisions of the Regulation of the Minister of Climate and Environment of 22 March 2023 on the detailed conditions for the operation of the power system (Journal of Laws of 2023, item 819) to the Ordering Party's collection points. The energy will be consumed for the needs of the Ordering Party, which is an energy company within the meaning of the Energy Law of 10 April 1997 (consolidated text: Journal of Laws of 2022, item 1385, as amended), whereas the subject of the contract consists of:
1) supply of electricity in the planned estimated amount of approximately 3500 MWh in the period from 1 January 2024 to 31 December 2024 to the facilities of the Contracting Entity, but not earlier than from the date of effective implementation of the procedure of changing the electricity supplier at the distribution system operator (DSO), if it is necessary to carry out such a procedure.
The Ordering Party informs that the forecast of energy consumption indicated in point 1 above is only an approximate value, which during the performance of the contract may be increased or decreased in relation to the forecasts for the end user. The actual energy consumption will depend only on the actual needs of the final customer, however, regardless of the amount of consumption, the Contractor is obliged in each case to apply the energy prices offered in the tender. The Contractor may not pursue any financial claims (compensation) from the Contracting entity if, during the term of the contract, the Contracting entity purchases from the Contractor a smaller or larger amount of electricity than the forecasted amount of energy indicated in the SWZ, in particular caused by an increase or decrease in the expected energy consumption for the end user, a change in the tariff group, a change in the ordered capacity or technical parameters of the Energy Consumption Point, actual energy consumption at the Energy Point, with the proviso that the Ordering Party guarantees that the minimum amount of electricity it will purchase during the term of the Agreement is 1200 MWh.
Electricity must meet the technical parameters in accordance with the provisions of the Energy Law and the implementing regulations to this Act and Polish Standards.
2) collection of electricity generated in the Ordering Party's RES installations in the period from 1 January 2024 to 31 December 2024; The estimated amount of electricity intended for purchase and delivery to the DSO network in the above-mentioned period is about 950 MWh and is indicative.
The Ordering Party declares that it is entered in the register of electricity generators kept by the President of the Energy Regulatory Office and is obliged to calculate and pay excise duty on electricity produced and consumed for its own needs in the RES it owns.
