The State of North Rhine-Westphalia acknowledges its legal and humanitarian obligation and responsibility to accommodate and care for asylum seekers in accordance with the Asylum Procedure Act. Their accommodation, care and support is supported by the principle of humane and respectful treatment.
The emergency accommodation facilities (NU), the central accommodation facilities (ZUE) and the initial reception facilities (EAE) are institutions of the state of NRW. The facility management is the responsibility of the local employees of the respective district government. The employees of the district government are contact persons for all those involved on site and the only liaison office to the respective district government. In case of doubt, the final decision-making authority for all conflicts of competence arising in the reception facility lies with the employees of the state.
The contractor shall coordinate and organise the trouble-free and proper operation of the accommodation facility. In doing so, the contractor ensures compliance with the legal provisions for the operation of a shared accommodation in consultation with the local authorities (e.g. Infection hygiene according to IfSG with the local health department etc.).
The tasks of the contractor do not include the exercise of sovereign activities, in particular with regard to the asylum procedure that the accommodated persons have to go through. Nevertheless, the contractor is obliged to support the client in the execution of his sovereign tasks.
Further information on the specific tasks can be found in the service description.
