3. In a situation where the Contracting Authority used trademarks, patents or origin, source or specific process which characterizes the products or services provided by a particular Contractor, such action was intended solely to indicate the expected by Contracting Authority features of supply or services. In any case, the Contractor may propose solutions equivalent to those described, guaranteeing the achievement of parameters not inferior to those indicated in the order documents.

4. In any case of use in the description of the subject of the contract of the standards, technical assessments, technical specifications and technical reference systems referred to in Article 101 (1) (2) and paragraph 3 of the Law p.z.p., the Contractor shall assume that the words “or equivalent” shall be accompanied by such reference.

5. If the Contracting Authority allows solutions equivalent to those described in the procurement documents but does not specify the minimum parameters to confirm this equivalence — the Contractor is obliged to offer a product with similar properties, functionally suitable for the required applications.
