Description:
The project involves expanding and modernizing the Intelligent Transport System in Gliwice to enhance road user safety and support low-emission transport, executed in two phases: design documentation preparation and subsequent construction and implementation.

The subject of the contract is the expansion and modernization of the Intelligent Transport System (hereinafter referred to as “ITS”) in Gliwice as part of the project titled: “Development of sustainable urban transport mobility in Gliwice” in order to increase the accessibility, comfort, and safety of road users and to support low-emission urban transport. The contract will be executed in a “design and build” formula and includes two main stages: Stage 1 (Design) – preparation of comprehensive design documentation for the ITS system, including the concept of modernization and expansion of subsystems, traffic organization projects (permanent and temporary), as well as obtaining the required opinions, agreements, and permits necessary for the execution of the works. Stage 2 (Implementation) – carrying out construction works, supplying and installing devices, and implementing and commissioning the ITS system in accordance with the approved documentation. The order also includes ensuring the integration of all subsystems, operational support, warranty service, and training of the Ordering Party's staff in the operation and use of the expanded system. A detailed description of the subject of the contract is included in Appendix No. 8 to this Specification of Contract Terms (SWZ) and in the Functional-User Program (PFU) – Appendix No. 17 to the SWZ. The task titled: “Expansion and modernization of the ITS system in Gliwice” is being implemented as part of the project titled: “Development of sustainable urban transport mobility in Gliwice” under the European Funds for Silesia 2021-2027 program (European Regional Development Fund) for Priority: FESL.03.00-European Funds for sustainable mobility for Action: FESL.03.02-Sustainable multimodal urban mobility - ZIT. Required warranty period: 60 months from the date of final acceptance of all works covered by the contract. Required period of liability: 60 months from the date of final acceptance of all works covered by the contract.

Equivalent solutions 1. Allowance of equivalent solutions: The Ordering Party allows the Contractor to use equivalent solutions regarding materials, devices, software, standards, technical assessments, technical specifications, or the technical reference systems indicated in the SWZ or its appendices (including PFU). These solutions must: a. be existing, actually implemented, and tested - design or planned solutions are not allowed, b. ensure the execution of the order in accordance with the requirements of the SWZ and its appendices c. guarantee technical, operational, and use parameters not worse than those specified in the contract documentation 2. Definition of an equivalent solution: By an equivalent solution, the Ordering Party understands software, devices, and materials as well as technical solutions that ensure compatibility with the Ordering Party's systems, possess functionalities and parameters not lower than those specified in the SWZ and its appendices, including the PFU, and meet all functional and quality requirements set forth in the procurement documentation. 3. Equivalence criteria and documentation: In the case of proposing an equivalent solution, the Contractor is obliged to submit documents confirming its equivalence, in particular: a. references confirming previous implementation, b. certificates, acceptance protocols, or other documents confirming technical parameters, functionality, and compliance with the requirements of the SWZ. 4. Documents confirming equivalence will be treated as relevant evidence within the meaning of Article 107 of the Public Procurement Law. The Contractor is obliged to submit them along with the bid. 5. According to Article 107 (2) of the Public Procurement Law, if the Contractor does not submit relevant evidence or the submitted documents are incomplete, the Ordering Party will call for their submission, completion, or correction within a specified period, subject to Article 107 (3) of the Public Procurement Law. 6. Relevant evidence aims to demonstrate that the proposed solution meets the requirements specified in the SWZ, including regarding functionality, technical parameters, and compliance with the Ordering Party's systems. 7. An equivalent solution that does not meet the requirements of the SWZ and its appendices will not be accepted by the Ordering Party. The Ordering Party reserves the right to evaluate the equivalence and refuse to accept a solution that does not meet all required criteria. The Ordering Party specifies equivalence criteria for the proprietary names used in the PFU in Appendix No. 10 to the SWZ.
